Desperate need of advice/help!

    So, here's the story. I gave my Merc SL 55 and 15K cash for a total of $50K as a mark up so I could get a 2011 458 Italia in Jan 2011. How they worked the $50K was, They gave me a check for $1.00 for the Merc and 15K was for ferrari sponsorship or something like that. They haven't received allocation for 2011's yet so I haven't technically ordered the 458 yet. I've had second thoughts and was thinking maybe '09 Scude. They say that the 50K is gone and I can't put that towards the scude. I'm thinking they say that because if I get the scude, they're actually only getting 9% of the sticker price because they're selling it for another client. If they convince me that I can't do that, then i get the 458 and they make full sticker price on that car. So I'm wondering if it's true that the 50K is gone because in actuality like I said, I haven't ordered the 458 yet or if thats their hustle? Would those who have experience please enlighten me. Thank you guys so much.

    by the way they wrote it... they are correct in the fact that you lost the 50k... they provided you proof that they purchased you car and they recipeted the sponsorship in a manner in which you can't and they can't prove was for the scud mark up. In my opinion this is a dangerous transaction, but probably happens all the time. I would never ever do anything like that. but thats just me. My experience as many people is limited. It sounds like that isn't the issue though and you believe they will come through on the deal.

    It sounds like your main concern is the them forcing you to take a car so they profit more. Is that correct? are you saying the 9% because that is the alleged mark up on the scud? where does the 9% come from? Im sure if you throw enough weight around, you will be able to get what you want... the above transaction sounds pretty jicky and if they want to keep there names off of ferraris list and out of the BBB they should comply.


    Who knows... maybe im way off base

    The way I read your sequence, it appears you willingly sold a $35K car for $1 and then also gave them $15K for intangible benefits (sponsorship). Unless you have some paperwork that says they gave you a $50K credit somewhere, then that's probably it, unless they relent. Perhaps they did it this way because they're not supposed to sell new cars over MSRP (I've heard mixed stories about whether FNA cares about that or not) or because then it's not a deposit (which is refundable in many states)? Perhaps a weak spot in the shenanigans here is that it could be made to appear as participation in sales tax evasion (for the $50K) by the dealer (and also you). Do you even have a firm contract for a build slot for the 458? You may need to speak to a consumer rights or contracts lawyer for your state to get a definitive opinion on the whole mess.

    Basically the scud is being sold for another ferrari owner whose willing to give up 9% for the dealer to sell it for him/her. So the dealer gets that 9% and the rest goes to whoever the scud's owner is. I figured from how they worked the $50K that I was locked in. Don't get me wrong, getting a brand new 458 when I want it without waiting on a list isn't bad at all. Especially since the Scuderia is kind of yesterday's news. Was just wondering if that was the 100% case.

    Actually no, no contract. Last I heard was that I'm going to have to spec my order out when the dealer receives allocation for 2011 build which should be any day now. Will definately take into consideration. Thanks guys.
