BMW Sauber is to officially join the FIA's International Court of Appeal hearing into the diffuser row as an affected party, as teams continue to ponder about lodging a fresh protest at this weekend's Malaysian Grand Prix.

Ferrari, Red Bull Racing and Renault have already appealed against a decision by the Australian GP stewards that the diffuser designs on the Brawn GP, Williams and Toyota cars are legal. That hearing is to take place in Paris on April 14.

BMW Sauber had originally planned to protest the diffuser gang in Australia too, but its complaint application was not completed in time.

Despite missing out on the initial appeal process, the team has now notified the FIA that it wishes to join the hearing so it can put forward its belief that the diffusers are illegal.

"We have announced that we want to be heard in the Appeal [hearing], and that has been confirmed by the ICA," BMW motorsport director Mario Theissen told AUTOSPORT. "We are joining as an affected, or concerned, party."

BMW Sauber is currently evaluating whether or not to protest the diffusers in Malaysia, perhaps after the race, with Theissen being seen in discussions with Ferrari in the Sepang paddock.

Theissen said: "It is open what we do here."

Red Bull Racing team principal Christian Horner said in Malaysia that his team was unlikely to join any protest in Malaysia, but could not rule out another outfit doing so.

"I wouldn't be surprised if there were a protest this weekend," he said. We've been through our process in Australia and we have our appeal date and that is what we are working towards."

I guess that decision is *nothing* to do with the fact that they're in 17th and 20th position after P2......;)

Yep, you hit that pretty much right on.....and the BS just continues. No wonder why my dad has given up on F1...

I'm still young enough to put up with the 'entertainment value', since it has ceased to be racing a long time ago....

 Really? Because it seemed like there was some racing going on last weekend.

It’s all part and parcel of the game. Actually I'll side with a certain famous writer and declare that it's not a game, as other "sports" are. The appeal will certainly fall on deaf ears as the non diffuser teams have shown that they're capable of showing good pace. It doesn't do them any good to top the time sheets as Ferrari did today and then cry "foul." The FIA are interested in the rules but they're more interested in a level playing field. The current non-diffuser teams have shown that they're not at too much of a disadvantage but if you were to take a way the diffuser off of the three they'd have a performance deficit to the others. Two rulings in favor of the diffuser and apparent parody of the non-diffuser teams lean toward the tricky three keeping the diffusers.

And to me watching how teams interpret the rules and how they evolve the cars is as much fun as the racing on the track. This year seems to have both in spades. Tell your dad to put his seemingly bad attitude aside and enjoy the racing. As someone who watched his first race in person in 84 I can tell you it's no different now as it was then. The names, faces and rules have changed a bit but at its core it's the same.
