    Cocktail waitresses are hired in part based on their ability to generate sales and tips right? Part of generating sales and tips for a cocktail waitress is their appearance. Changing their appearance could change their level of ability at their job. If they don't have some sort of policy about it would just makes it that much harder for them remove people who have allowed their weight to become a serious enough problem to effect business.

    I mean really, should a bar keep a stripper after she gains too much weight? Why should a Hotel have to keep a cocktail waitress after she gains too much weight? Hell they're not even discriminating against women seeing as they're applying it to men as well.

    I suspect it is a lot more common than this article makes it out to be. Interesting that they set it based on a 7% gain though. What about the for guys? I would be pissed if I put on 15 lbs of muscle and got fired.

    It'd make a lot more sense if that "& Spa" part was more than just marketing.
    Would you go to a health club run by an overweight chain-smoker toting an O2 tank?

    But the part about the casino paying for someone else's weight loss program implies that they're not running their own.

    But what is your office employer "implying" when they install an exercise room in the facility? ;)

    Very fair. Nobody forces anyone to work there. And many employers have specific requirements for employment. What's the beef?

    It's actually a very effective policy. When you go to the Borgata you know you're going to the nicest, most aesthetically pleasing casino in A.C. If any of you have been to the other casinos here, you know that the coctail waitresses usually look like your grandmother!

    WHen they get sued, and they WILL get sued, maybe they can use the opposite of the McDonalds "We're not responisble for our own bodies and the evil Company made us fat" Offense :)

    "You forced us to be healthy & attractive against our will" I guarantee the Supreme Court will rule against the casino. Anything that makes too much sense is now Unconstitutional

    Working for one of these organizations, like Hooters, and then complaining about the consumers that frequent it is denying any sort of responsibility they had when they accepted the job in the first place.

    Send them to Germany to become welfare prostitutes. THEN lets see how bad they complain! ;)

    It does apply to male and female alike, though 7% weight gain is a little arbitary. What if the weight gained is in muscle and they look hotter. How about 10% increase in body fat percentage? (then it'll require tests more extensive than weigh-in, etc.)

    Hey, you took a paying job because of your tight ass. If I forgot how to program a computer tommorow, I'd be out of a job too. Maintain your ****. Nobody's asking to loose any.

    Don't see really nothing wrong with it except they probably don't educate people going on suspension about proper healthy weight loss. The military has been doing this kind of thing for years and some in the military have jobs that won't even let them see any combat. The military does not want fat people because it causes an unhealthy image for the people in uniform.

    Ugh...I don't think that the military doesn't want fat people for image reasons. You need to be nearly perfect (little things could prevent you from being enlisted), and have a certain level of intellect.

    While I'm undecided as to the fairness aspect, I can see the Casino winning. Especially if this was clearly noted in their employment contract - I'm sure the casino will rely on military hiring practices and perhaps precedent from Hooters lawsuits (assuming hooters has maintained their right to hire selectively based on "presentation"). The right to freely contract is a huge one, I think only a few circuits like CA would attack it (NJ has a long history of the same 'liberal' judging lacking precedent though).

    If looking attractive to a minimal level is a clear prerequisite for a Borgata Babe like athletic ability for an athlete, analytical ability for a scientist or acting ability for an actor (although attractiveness replaces ability in many instances of acting), there could be strong arguments. If the court ruled against weight selectiveness (I'll avoid the charged word "discrimination" which has been tainted by negative use), this would affect a multitude of industries.

    In an easy rebuke to the loaded spew from that Zimmerman lady, women don't have to starve themselves, just have a balanced food intake and moderate exercise. While I have some sympathy for the victims of these social fear-induced disorders, smoking, eating poorly and then puking is not the way to balance your diet. I would also discourage hiring smokers, because this reveals a lack of concern for one's body and health. I have a sneaking suspicion though, that such vices go hand-in-hand with the lifestyles of people who end up being cocktail waitresses.

    Now, if I were a marketing/PR person for Borgata, I would try to include dietician consultation and fitness club time and privileges for the 'Borgata Babes' to help them with their careers at Borgata. You could market it like the 'Babes' will be all over the Spa area too, being pampered and exercising along with the old men (and their wives, but it's the men who will want the constant presence of the babes). Then you would have the spin that being a Borgata Babe is a healthy career and they'll help you make smart choices.
