    Maybe I am the last person to know this but I thought that it is wrong the way they deal with their disputes. Here is a live chat I had with an Ebay employee today.

    My auction was ended early this morning from a member that hit the "buy-it-now" option for a total of $250,000. I was excited until I looked into the buyer and seen that he had no feedback, he created the account today and is now no longer an ebay member. This is wrong! He created an account just to screw my auction over and then ran off of ebay. This is more than just someone who forgot to pay, this is complete malice behavior and I want to go after this member to the fullest extent of the law. I have his contact info from the email ebay sent me in the winning bid email and I plan on contacting an attorney in his state unless you can solve this problem.

    Sorry to hear this happened to you. Since the buyer is Not A Registered User, this means that they unregistered, or eBay removed their account. You will be able to file the Unpaid Item Dispute right away to get your Final Value Fees back on this listing as you will not have to wait when the buyer isn't registered. Would you like me to show you how to do this?

    The problem I have with that is that he gets nothing. He is already a non-member. Is the "legally binding contract" in your rules just a threat for people to pay or does Ebay actually do something about it?

    Those rules apply as long as they are registered members of the site. If the buyer becomes Not A Registered User, you are no longer obligated to complete the transaction. You can request the fees back on the auction and simply relist the auction back onto the site again.

    I will have to remember that, maybe I should bid $2 million on a new Ferrari auction and then tell the guy to screw off because I am no longer an Ebay member.

    I understand you're frustrated with this. This is put in place for your protection, as if the buyer was bidding fraudulently on your listing eBay would remove that members account, and it would show as Not A Registered User beside their name.

    I realize all bids are binding, however in this case you'll want to get your fees back on the item and get it relisted onto the site.

    Absolutely. No offense to you but I have copied our conversation and I am going to post it on some message boards to show people that Ebay says this behavior is acceptable as long as they cancel their membership and that the "legally binding" is just a scare tactic.

    I have come to the realization that eBay is a joke.

    eBay, as we know it now, will not exist in 10 years. I do not know what will happen - maybe regulation, maybe competition, maybe change from within, but eBay is rife with scams, unscrupulous behavior and it seems eBay does nothing about it.

    It would be/is amazingly easy to scam someone on eBay, and they know it happens to the tune of millions (or maybe billions) per year, yet they do nothing to stop it.

    That really sucks. E-bay is getting worse and worse and scarier to deal with each day. Too bad there's not a way to send a surge of 480 volts through computer lines to these dik wad trolls.

    I had issues with eBay previously and was able to get the phone number to the President and called him directly. I can find the information if you want me to, his assistant was able to get things done. These clowns can't do much.

    BTW, for future reference..with auctions of this caliber it is possible to make the bidding by invite only. That way you can weed out potential scumbags

    Yea, try this. I'm not sure what the damage is here? You get to relist, lost a bit of time and you've learned how to prevent this in future. IMO ebay is very aware of the problems and are making an effort to prevent this stuff. They seem to be reacting much quicker these days. The very nature of the internet leaves things wide open for scams. With some serious due diligence I think ebay is still a good way to go. Unfortunately there are a lot of people abusing it.

    There certainly is no binding contract with Ebay.

    Relist your item immediately and file your unpaid item dispute in 10 days and youll get your fees credited because of what some jerkoff did. Chalk it up to the cost of doing business and move on. Its happened to me a dozen times. No sense getting worked up over it.

    What are you going to do? Spend your time and money pursuing someone you dont know, have no info on and who probably is a kid messing around?? Im sure you have better things to do.


    Vent your frustrations to us and move on.

    According to a friend in the FBI, my info has been out there for a long time. All of YOUR info is out there too!

    Since I was burglarized in April ALL accounts have been closed and changed with security alerts and passwords.

    All personal information is flagged with all credit agencies.

    I have 24 hour monitoring on all accounts and credit.

    Let 'em try........................................

    I have no intentions of actually suing anyone I just thought I would tell them that. Of course, they didn't care. The whole thing that pisses me off is that everyone knows that Ebay pushes the "Legally Binding Contract" part of their rules. I took this as literally, not "Binding by Ebay Law". Anyway, just thought I would put out some bad press since they didn't seem to give a crap. No loss on my part except a little time and one days dreaming on what I would buy now.

    Let's say that Ebay did in fact go after the original bidder and bind him to the contract - that might take a while - and during that time you'd be bound to hold the item to sell to the bidder. Don't forget that you are also bound to sell it to the bidder.

    It seems to me that it is in YOUR favor for the contract to not be binding when in fact the bidder doesn't have the intent to pay. You could spend months waiting for the legal process to extract the money from the person, and during that time you could have sold the item to someone else.
