fender bender question

    Last week, while sitting in Miami traffic, I was rear-ended by a (beautiful) new Aston Martin DB9. the collision was <10mph, and the damage is moderate -- his grill will need repair, and my bumper will probably need to be replaced due to dent and scratched paint.

    The owner was very nice -- took full responsibility. In fact, we chatted about cars for an hour while waiting for the police to arrive. (He is a former ferrari owner x3).

    Anyway, I get a call from his agent this week asking me to get an estimate so they can decide whether to file a claim or pay directly. I asked him about a rental car, and according to him I have to go through my own insurance if I need a rental car. Otherwise, I am stuck taking a bus to the hospital at 5am (well, not really -- i could borrow one)

    This doesn't seem right. It's enough of an inconvenience to me to have my new car in an accident, not to mention taking it to the body shop. Having to pay for a rental is adding insult to injury.

    Do I have the right to expect a rental car? Anyone with experience have advice?

    also -- the guy's insurance was through a Chubb's subsidiary -- not sure if that matters

    I know insurance varies by state, but here in NJ we get a daily allowance towards a rental car. I believe it's $25/day at the moment.

    Why not get an estimate and add the cost of the rental car? If he doesn't want to pay it, then his insurance company should.

    My wife has been hit twice in the same manner as you. Both times, the insuring company was State Farm. Once, there were no hassels, retal car and everything covered immediately. Her rental car was equivalent to what she was driving and for the use needed. She received a SUV since they had no trucks left at Enterprise. On the second instance, they started giving the run around and that they did not have to cover for the rental. We told them fine and contacted our Insurer(USAA). We just put it in our companies hands to fight since this was not our fault. USAA setup our rental and just tacked it to all the damages they would be seeking from State Farm.

    The bastards.

    They need to get you a rental, fix your car, PAY YOU FOR DIMINISHED VALUE AS YOUR CAR IS NOT WORTH AS MUCH AT RESALE. Don't let them say they "don't do that".

    ANY TIME you have an accident you should contact your insurance company. Then you should go through your insurance company to get fair compensation. They will subrogate the claim to the other parties insurance company if they find he's at fault. If you try and do the guy a favor outside of insurance companies you run the risk of being scammed and / or him changing his story.

    Of course they should pay for another car to drive, he was at fault. Your insurance company might have a limit on what they will pay for a rental car, but you are reasonably entitled to a car of equal value. So, if according to your policy they will only pay "x" amount, you can file suit to recover the rest of your damages. The fact that they don't want to cover a rental car is a bad sign.

    You don't seem like a pro with this type of problem, you have insurance....... they are the pros.

    Under my insurance I'm entitled to a rental whether I caused the collision or not. If I use a rental and I wasn't at fault, the other insurance company pays the rental cost. Tell the Aston driver to cough up the dough or he'll have an insurance claim on the books.

    thanks, everyone for the prompt and helpful replies!

    I called my insurance agent. She agreed that it was fishy for them not to pay for a rental. If I file a claim with (my) State Farm, they will pay 80% of my rental then subrograte for reimbursement.

    I really don't like the idea of having to go through my insurance company, though. I am still of the mindset (correct or not) that you don't want many claims on your record (even for things that aren't your fault) for fear of rate hikes.

    In my simplistic view of the world, I should not have to pay out of pocket or lose money for something that is clearly someone else's responsibility. (but that's just my naivete)

    man, why can't that happen in st louis? sry to hear about the accident, but what i was going to add has already been stated, there's no reason why the other guys insurance shouldn't pay for your rental car.

    When my M3 was rear ended my a Lambo...he was at fault. We both had State Farm. His insurance paid for my rental and everything 100%. It took six weeks to fix. They sent the wrong parts to the repairer. Car was undriveable bercause couldn't open the gas cap door.

    They gave me a GM SUV to drive. Fortunately had the Ferrari to drive for pleasure.

    If you can, get hit by somebody with the same insurance. They will just pay as they can't sue themselves. :) Maybe everybody should have the same insurance....hmmmm.
