Ferrari approval process?

    Hey folks,

    I'm hoping you can help point me in the right direction. I have some custom fabricated items for 308s that I tried selling on e-bay... but I got shut down for Ferrari trademark infringement. I've been trying to find information on how to become Ferrari "authorized" to sell using their mark... but I've come up empty-handed.

    Anyone have suggestions or ideas on this topic? I greatly appreciate any help!

    Contact Ferrari North Americas legal depatment in New Jersey.

    They are very protective of the trade mark and will charge you dearly for its use even if they do approve of your product carrying their name. Unless you plan on $$$$millions in sales it will not be worth it.

    For what it is worth, RFDriver is absolutely right IMHO. (It will not be worth it).

    Did you notice that nice little Testarossa on the package of paper towels in the Testarossa section? Probably FNA would have the junior legals after that if they had any idea it was there.

    I happen to like scale model trains. Burlington Northern/Santa Fe recently put the shakedown on everybody who ever made a scale model WarBonnet F3/F7/PA Diesel (which is probably everybody who ever made a model locomotive since 1950) for "trademark rights".

    I would think (like to think) that companies like this railroad (and also Ferrari) would be glad that people admire their work and are willing to help them publicize ther product.

    But I guess not.

    IIRC that pic on the towels you posted had the nosebadge removed and there wasn't a reference to Ferrari . The towel manufacturer may be able to skate on that one. Note: I am not a lawyer nor do I play one on TV but I do watch a lot of Judge Judy :)

    You'll just have to figure out a way to circumvent the F-cops. There's a ton of F stuff on ebay so how are they doing it? Not sure what you're selling but can you leave the F reference off of it? I wouldn't roll over to those control freaks if it's a viable product. Good luck.

    i agree w / everything above. Theyre very protective of the brand. I dont she why you couldnt sell "Ferrari Replacement" parts.

    You just need to word your ad such that it's clear that your product is made for use on a Ferrari, but is not made by Ferrari.

    From experience, if Ferrari finds out about the paper towel, they'll sue them.

    Find below one of the copyright lines of Ferrari...

    FERRARI, The PRANCING HORSE device, all associated logos and distinctive designs are trademarks of Ferrari Spa. The body designs of the Ferrari cars are protected as Ferrari property under design, trademark and trade dress regulations.
