    Hello,

I am looking at a car that has no service records currently with it. We know that it was serviced at FoSF but they want the previous owners permission to release the records. Normally I see records with the owners information redacted so I am not sure what the issue would be. Can anyone shed light on this?

Many jurisdictions, both statewide or national, now have laws governing the release and disclosure of personal information such as names, addresses, and phone numbers, etc, not to mention other things such as the substance of the transaction. Pretty common nowadays. Here in Canada it is a national law referred to as PIPEDA.....Personal Information Protection Electronic Document Act. The dealer is just performing CYA.

    Hello,

That make sense, but all of the records I have looked at before have the name/phone/etc all redacted. Is the actual information in the service records protected too?

That is interesting! I guess that is why there are so many storied cars out there, if you cannot get the service records how do you know what happened with it?

Do you have the current owner's permission to view the records? If so, it should be no problem... I know this for a fact, PM if you need more details.

The current owner is the dealership asking for the records. They were told they need the previous owners permission to release the records.

    You have a PM.

Never had that problem. Owners name and address was simply blacked out on the records. I couldn't take them with me, but I could review them at the dealer.

+ 1 It would help if you knew someone working at the dealership which in this case it appears that you don't but still it shouldn't be a problem.

Hmmn, maybe I was lucky, but I called the dealer where the car was serviced and they blacked out the prior owner's info and faxed me all the records from day 1 on the car...

I understand hiding the previous owners name and info. But to hide the records of the mataince for the car you are wanting to purchase is rediculous!

If that's a law.... Then the insurance companies should not be allowed to ask your health history to base your rate on, or cohhse not to cover you at all....

Look at it this way.......the buyer of a used car I "once used to own" has no inheritable right to view the details of my former business transactions with another company regarding said vehicle, unless I so authorize him to do so. The other party to the contract is legally responsible to protect that information for my benefit.

If I am selling my car to someone in the first instance I'd certainly release them to prospective purchasers prior to the cheque being written. What that new owner does after the fact with the paperwork isn't my responsibility nor is it incumbent upon me to maintain a legal chain of records accessibility for potential future buyers.

If you are the second, or fifth buyer down the line, etc, and want me to release them it's not my problem anymore, as it's not my car, hasn't been for a while, and therefore I will not open myself up to any potential liability by doing so.

Most likely this less to do with FNA and more to do with the American legal system...

    Bingo.

As one of my General Managers once told me "If they have no information, we have less liability".

People sue for the craziest things.

    The long way home
Seems to be hit and miss, at best.

While shopping, I've had everything disclosed (including personal info), had personal info blocked out, been told 'no' by one adviser only to get it from another, been flat-out denied, etc. Seems to only matter who you talk to on what day...

I have the records, anyone online have time to look over them with me? I don't see the Variator campaign, and the problems I felt with the clutch/shifting are noted. Also the radio is noted as not working (not that I checked it.. got a nice one in the back ;). Other then that the car has been regularly serviced and is about 1 1/2 years to another belt change.
