did Jim and/or Pininfarina allready agreed to licensing the design of the P4/5 to modelbuilders?

Having said that, the model looks great and I wouldn't mind having one in my collection.

about doing a kit, he said he was already working on a licensing agreement. He never said with who, or under what circumstances...

    yes, GG50 !

if you make some models of a car (1 or 5 models or 10 maximum) , I do not think that it is necessary to have authorizations. If it's just for your collection !
    I think............

You can make one from scratch yourself. Which also means you cannot go to a place that will custom make it for you for a price, then they would be profiting off of Jim's design. I also don't think you could sell the model or something like that without his permission.

If Jim makes a 1/18 of the P4/5, count me in.

I am just a collector of beautiful cars, I seek models rare and beautiful. ;)
I often find some on Internet or in "secondhand trades" (brocantes/bourses d'échange in french langage).

I make scale model cars as part of my living. Have been doing so for over 15 years. According to my lawyer who does copyright and patents I can make something like 500 models of ANY single car, and sell them, and do not need any permission from any maker to do so. I make and have made Ferraris, advertise it on my website and if they want to send me a letter to stop they are free to do so. I am not a lawyer but if I recall correctly it falls under an artform clause and the number of units is more than I could possibly sell anyway.

So far nobody has tried to stop me. And if they did I would be willing to test that law in a court if it came down to it.

Contact a good attorney and they will clarify

That is absolutely absurd. The lawyer who stated that to you should not practicing law. If you are making any model for commercial sales you are infringing on someones or some companies rights, and it is very very punishable.

also you should stop posting your company name until you become a sponsor

I didn't know you were attorney. Are you practicing law as well as selling models? Can you give the section of law that says what you are arguing? If not than do yourself a favor and contact an attorney. They will clarify. You can also look it up on the web. Are you infringing on a companies rights when you take a picture of a particular image and sell it? It gets very grey.

Like I said, I've been doing this a long time.

And the lawyer that researched this info for me is no small time attorney. I'll see if I can get him on here and give the details.

When an artist creates an image it becomes there own. If I create a model, its my design. If someone owns a car and wants a model of it, I do not need to go to the designer of the car to build the model.

I've been posting on here years before you have and the moderators know who I am. If they have a problem with me posting my name I think they would have told me by now. I didn't realize you were also a moderator in addition to a lawyer.

I have inquired about sponsoring but did not get a reply. I will sponsor if they want me to. Its no problem. At the time I joined this forum I was told I can put my webpage in my posts and I very rarely do that anyway.

Calm down, I not trying to move in on your customers. They probably know me anyway.

For your information, you are violating Ferrari's Copyright as well as Trademark. What you are doing is both Trademark Dilution as well as Copyright infringement.

It is not my responsibility to inform you of your legal rights or to be concerned for the state of your business. It is however, a concern of my company when you are unethically and illegally competing in our industry.

Please do not contact me or post your information on a site I am a sponsor of until you consult with your attorney again.

    Thanks,

    LOL!!

    OK!!

I never contacted you. I replied on a message board, thats a bit different. If a moderator wants me to stop posting until I become a sponsor I will of course abide by that decision and sponsor, no problem. As far as you telling me to do something? I must admit that was the hardest I have laughed reading a message board in a very long time.

I am hardly unethical as many of my customers on this board will tell you (they were customers before I was a member here, by the way, so try not to have a stroke) and as far as my competing with you I really don't consider you much competition as I think we have different types of clients. I am sure you are skilled at what you do, but I'm sure its just not the same.

I build 1/24 and 1/12 scale high detail hand built models. I also produce patterns for myself and others. I wholesale my small selection of limited production self produced kits and hand builts. I also retail for just about everyone. I don't do much 1/18 scale but, hey, maybe after tonight and this ridiculous thread I might jump right into it!!

Relax Steady Eddie.........Just having some fun with you since you're providing so much. I'm not into the repainting diecasts business as I think you are.

I do not come on here looking for customers. I actually come on here because I enjoy talking about Ferraris and cars in general. I have enough customers and business to keep me plenty busy (I just needed a break tonight and boy was this it!)

Needless to say, you can contact me anytime. I'm very easy to get ahold of (well I was until you imposed your unofficial GAG order!! Great stuff man). I'm not afraid to have a discussion. You quote these laws as if you really know what you're talking about. But you are probably more angry and upset because of other issues you may have.

We build model cars.....get over it.

I agree, why shouldn't you be able to? Your point about artwork is true, artists don't get permission before they start work on a particular piece. What you are doing is no different.
