    Flavio's back in the news... hope he's successful against Max et al - alleging that it was excessive desire for personal revenge on Max's part - Symonds to also join his appeal.

    Disgraced former Renault team boss Flavio Briatore is seeking one million euros in compensation as part of the legal action appealing against his lifelong from F1.

    Earlier this year, Briatore was effectively banned from Formula One for life for his part in Renault's race-fixing scandal, which motorsport's governing body said was of "unparalleled severity."

    The flamboyant Italian's punishment was the more severe of those handed out as Renault were only given a two-year suspended ban while former director of engineering Pat Symonds was banned for just five years.

    A month later, Briatore announced that he was taking the matter to court, applying to a French court to have the ban overturned, saying at the time that it was "disproportionate and illegal".

    Now Briatore has gone even further, alleging that former FIA President Max Mosley was "clearly blinded by an excessive desire for personal revenge".

    The Guardian newspaper reports that the 58-year-old is not only seeking 'a total annulment of the FIA's instruction to its members - race organisers, teams or drivers - not to have any dealings with him' but also 'a minimum of €1m (£900,000) in compensation for the damage to his reputation.'

    In his statements, Briatore claims that the FIA contravened both it's own International Sporting Code as well as the laws of France, referring to the "the excessive and abusive power clearly exercised by both the World Council, in particular, and the FIA, in general" and "the breach by the World Council of the most basic rules of procedure and the rights to a fair trial."

    In a damning verdict of Mosley's own role in the outcome, Briatore said: "The decisions to carry out an investigation and to submit it to the World Council were taken by the same person, Max Mosley, the FIA president." Mosley "assumed the roles of complainant, investigator, prosecutor and judge."

    As for why Mosley would have a personal vendetta against him, Briatore claims it was due to the "extremely violent disputes" between himself, representing the Formula One Teams Association, who were planning a potential breakaway series, and Mosley.

    "Mr Briatore had, in the constructors' names, in fact threatened the FIA and the FOM (Formula One Management) group... to instigate a parallel competition, organised without the FIA and without the FOM as rights manager."

    Briatore's comments, though, were not solely aimed at Mosley as he also felt Bernie Ecclestone "could, moreover, be hostile to Mr Briatore as a result of stances taken by him during the previous year on behalf of the constructors involved in Formula One."

    Briatore's case against the FIA will be heard by France's high court, the Tribunal de Grande Instance, on 24 , however, he won't be standing alone as the newspaper claims Pat Symonds will join his appeal.

    I'm conflicted...

    Flavio damaged Flavio's reputation. MaXXX Mutley just shine a spotlight on it...

    Yet, I believe everything Flavio says about MaXXX to be true...

    I always liked Flavio... I also believe there should be consequences for what the Renault Team did...

    I am certain if RD had done this, RD and the entire McLaren team would have been tossed...

    I am equally certain that if Ferrari had done this, it wouldn't have been proven...

    It has never been said who tried to discredit Max Mosley by setting him up with prostitutes for SM sessions recorded on video, and subsequently giving the evidences to the media in an attempt to discredit him and remove him from the presidency of the FIA.

    For a long time, I suspected Bernie, as this would be his sort of thing.

    But the successive eliminations of Ron Dennis and Flavio Briatore from the F1 scene within a matter of months, may indicate that Mosley found the culprits in that plot and managed to oust them out.

    yes, it is a bit conflicting isn't it - what they (Flavio and Pat) did was wrong but what Max did was also wrong and agree Falvio's statement about Max is true - perhaps more like a catch 22 situation?

    The whole problem stems from Cretin Mosley and his kangaroo FIA court system, sham legal proceedings.

    FIA/MaXXX justice system:
    The accused head is placed on a chopping block with an
    axe aimed at it. If the axe bounces off, the accused is guilty and
    is burnt at the stake.

    Everything Mosley has anything to do with is bent, N tech taking the FIA to court for the new team procedure, corrupt.

    Todt has his hands full to gain back any crediability to the FIA it stinks, and Mosley is to blame, the election everything a farce.

    Steve, thanks for my first laugh of the day - love your description of the justice system (such a truism). Did you see where the NTech hearing has pretty much been tossed out? I think if Todt wants creditability he needs to really not let this on slide under the door. I was astounded to see that Craw must have been in the Todt camp all along and to think I wasted time emailing him about a fair election.....apparently, he 's no different than the rest of the bunch.

    Yes I know how you feel with those emails I feel a mug, end of the day all those FIA members that supported Mosley are out for there stinking selves, Ari I believe would have swept the decks and that's probably what stopped him getting the job/votes.

    As Regards N Technology from a Blog: The case against the FIA in the Tribunal de Grande Instance in Paris had been officially decided appear to be wide of the mark. The decision was delayed until Friday and there is no official judgement yet, although it is believed that the leaks to the media reflect the decision that has been made. The case was heard in October and the judges have had a month to think about the decision and write the official judgement. N Technology was challenging the FIA claiming that there were irregularities in the process. There have long been rumours that anyone who wanted anything other than a Cosworth engine were rejected – and the teams chosen are all using Cosworths

    Who would have thought it leaks from the FIA..to the media that a decision had been made not in favour of N tech as was reported :eek:

    Surely in this case, Briatore Vs the FIA, all the FIA have to do is:

    A) Prove that Briatore was in on the plot from the start, to deliberately crash the car at Singapore to artificially affect the natural outcome of the race.
    (both Piquet and Symonds confirmed this in their testimonies to the FIA).


    B) Prove that when given the opportunity to admit his invovlement in this incident, Briatore continued to deny it, despite testimony to the contrary which resulted in an accusation of lying to the FIA.
    (again supported by Piquet and Symonds testimonies plus testimony from an undisclosed third party).


    C) Show any court the FIA rules and regulations that give them the right to punish offenders as they deem fit, up to and including permanent exclussion from the sport.
    (I believe bringing the sport into disreput cover this on it's own).

    D) Then, if need be, show Briatore to be untrustworthy based on putting pressure on Piquet to go through with the crash plan, in order to get a contract for the following season (which in itself is surely tantamount to blackmail?).
    (Again, this would rely on testimony from Piquet).


    I'm no legal expert by any means but this looks like a very weak case by Briatore, made even weaker by the fact that Renault decided to drop its lawsuit and side with the FIA when it was in receipt of of all the evidence involved in the case.

    At the end of the day, I just can't see Briatore winning this one.

    Bernie might have know how to hire a German Dominatrix, but I don't think he would. Ron Dennis would not have a clue how to go about it, but likely would have thought of the idea. Flav would have no problem finding the girls and might have already had their #'s in is cell. I suspect it was Ronzo's idea with Flav's implementation.

    I'm still trying to figure out what FOTA thought they were getting in return for dropping the break-away series.

    A chance for the manufacturers to individually drop out of a totally discredited F1 series, one by one?

    were really looking for something other than what they stated publicly.
    Who knows, money might have had something to do with it:)

    I love the irony of Flav leaking his case only for the FIA to respond :

    ‘The FIA condemns the selective leaking of extracts from Mr. Briatore’s pleadings to the Tribunal de Grande Instance in Paris.

    ‘The FIA rejects the allegations made in these leaks and confirms that the decision to impose a sanction against Mr. Briatore was made by an overwhelming majority of the attending World Motor Sport Council members.

    ‘In respect for the authority of the French Court, it would be entirely inappropriate for the FIA to comment further on this matter in advance of the hearing.’

    For the last decade anything and everything seems to have been leaked by them !
