    Free speech comes with limits, so it ain't always free. The1st amendment doesn't guarantee unfettered speech, the most common example is yelling "FIRE!" in a crowded movie theater. Not allowed, it'll get you arrested.

    There's no such thing as free speech on the internet either, at least not on FerrariChat.com, there's all kinds of stuff we don't allow. See the rules for details.

    If FoLI feels it has been defamed here by a user, they're free to bring an action against that user.

    Of course, the truth is the definitive defense against a defamation suit, let's hope the fchatter told it, as we have no way of knowing what you're talking about without a link to the thread or some more details.

    I would be interested to know as I am ready to launch a new business and this very issue is one of my concerns. does the user get sued or does the site get sued.

    funny, my first thread was erased somehow, not sure why. Anyways, foli is suing me for my opinions about them that i posted in the "foli experience" thread. i guess i hit a soft spot. Well i will not apologize for telling the truth and i guess we will see where this goes. the funny part is you can sue a someone for just about anything these days, but in order to get money from it, int his case he states he has lost 1 million in revenue from sales and service due to my comments on f-chat. lololol would think the comments of people on here that have actually done business there and had poor experencies with foli is the reason he has lost money, In fact if you look back through the posts as i did last nite somone even said to me that everything i have stated has been discussed numerous times on this site before in depth. So maybe i should sue F-chat and its moderators, or the other members on here for what they have said. The whole thing is so ridiculous,

    Oh im ready, they are opening up a whole can of worms now. If this was intended to scare me well try again. Its funny they are suing for a total of like 4 million, but then the lawyer(Elias Schwartz) says if i apologize maybe it will go away. Thats ok i think we should make a mockery of our court system and waste time discussing the facts that i acquired while working for Foli and or my visits to stuart's house on fridays. I think we should talk about it in court.

    Plaintiff can allege anything, but the burden is on him to PROVE it. In civil court, you're talking about a standard of the "preponderance of evidence" as opposed to "beyond a reasonable doubt". It's a lower standard, but nevertheless, it has to be met.

    out of curiousity, why would that comment disturb you? i understand that no one likes a whiner, but if the sales rep did the right thing and worked hard for the sale, he should get the credit instead of others, true?

    wow, another fan of foli or richard stein, which is it? If neither then you are just taking my words out of context. It wasnt the credit of the sale that i was looking for or the good experience that he had, What i was refering to was the fact that he hasnt mentioned that we had a business relationship prior to the FBI and previous lawsuit stating UAS stole his email address. Try to keep up with the posts, i hate repeating myself

    It is highly inappropriate and unprofessional to be airing all of this in a public forum, and especially so given there are lawsuits involved. I'm not trying to agree or dis-agree with you I'm just making an observation as a neutral 3rd party that has seen all this stuff flying back and forth on this forum...it's over the line of what is proper in a venue like this.

    Maybe not. It shows that the internet has power to reveal either a good or a bad reputation, for what it is. Years ago..... dealerships and businesses just went on their merry way, doing a good number of people wrong. The general public was none the wiser. Lots of places involved with dubious shenanigans have been nailed by internet chatter over the last several years. I'd say: If the truth is being told; Let the chips fall where they may.

    Clearly, you don't possess the ability to keep mum about pending litigation. This may be due to inexperience in this regard. However, civil matters are fraught with perils, and one of those is ignoring the right to remain silent, as anything one says can, in fact, be used against them in a court of law.

    You see, though the Miranda warning is specifically in place to prevent coerced evidence in criminal proceedings, it is advice best heeded by those in civil cases to prevent self-incrimination [read; ****ing themselves].

    So . . . in order to prevent you from doing further potential harm to yourself, your reputation, property, assets, both liquid and fixed, now and in perpetuity, so as to prevent you from understanding what the terms "lien" and "pawn" means forever and ever, amen. . . I'm going to assist you with preventative maintenance and your defense thereof by stating the following;

    You have the right to remain silent. Anything you say can and will be used against you in a court of law. You have the right to an attorney. If you cannot afford an attorney, you're pretty much screwed. Whether you understand these rights as they have been read to you or not, should you choose the high and mighty braggadocio route, I'll implement a ban of indeterminate length for your own good.

    In the meantime, we'll take care of the internet chatter. You can either chuckle or recoil in horror. It does you more good to keep your trap shut.

    This is the public file obtained regarding Scott Carlson; employee(computer expert) of FoLI, close personal friend of Stuart Hayim and ex-convict. So Stuart Hayim casts stones but this file clearly shows that Mr. Hayim, his sons, Gregg and Garett Hayim and staff should not do so. They want to file a lawsuit against Boxsterboy for speaking the truth, well there is a lot more factual info out there that will soon surface. I will make sure of it!

    +1...the internet has made the world so much smaller, educated consumers and exposed what some unscrupulous individuals would otherwise get away with. buying and selling items with six figure price tags...you bet the general public should know who they are dealing with!

    Wow, can't believe you found this, this is no secret. Anybody who worked for Stuart at massapequa Mercedes Benz or foli new this story, and either one had no problems discussing it. I was told he took the rap for the financier of it all(stu) and therefore Scott had well paid job and a Benz to drive after he got out of jail. Just what I was told by the manager at the time

    something just came to mind....there are 75k members on this forum and dozens of sponsors. of the sponsors there are several dealers many of them authorized ferrari. so i must ask the question, why is it that ferrari of long island has soooo much drama? so many that dislike them? under the previous owner and management there was nothing but love and kind words, under the current regime there is a considerable amount of bad press. as a matter of fact, after perusing the forum, ferrari of long island had the most bad press over all the other authorized dealers on fchat and most likely in the ferrari world.
    11 or so great years under rofredo...ruined in about 2 years...he must be turning in his grave.

    I don't know but guess I will find out. I just find it odd that some moderators on here egg me on and others read me my rights. What the he'll is the purpose of the moderator and don't they have some liability here to me, you and most of all their sponsors????
