If Global took $307,000 in cash, like in a duffle bag, they would have had to generate a federal forum (IRS form 8300). If they don't report this transaction to the IRS by the 15th day after the transaction they will be be in violation. More federal laws are broken here.

I recommend he drop by HPD and sign for the vehicle first, then maybe convoy out to Sugarland.... I had a law professor in college explain the gun laws in the US. He gave the example that in New York you have to retreat until you can no longer retreat any further before deadly force can be used. He then went on to say that in Texas if someone is walking on your property, feel free to take a headshot. Same guy who gave us the advice that the first five rounds should go into the kill zone and to save the sixth round to shoot into the ceiling...after all you need to fire a warning shot.

Official Statement from Global Motorcars of Houston of events as it occurred: Monday December 4, 2006 Sale Price $297,000.00 negotiated on 2006 Murcielago faxed over from Kevin of Cats Exotic. Bill of sales dated and signed by Kevin December 1, 2006. Also from Kevin faxed over December 1, 2006 with the signed bill of sales, he writes: We will release the car to your transporter with signed Purchase Order in hand. As the vehicle was making its way to Houston, Global Motorcars of Houston received phone call from Kevin asking for us to wire payment for the vehicle. Since we have never done business with Cats Exotic we offered to overnight a cashiers check to pay for the vehicle as soon as we received copy of the title. Kevin would not accept this form of payment. He insisted on a wire transfer without sending us a copy of the title. We ask if he would feel more comfortable completing the transaction through Mannheim Online Exchange. He again would not accept. He was rude, short, and threatened that if we did not send the wire within 30 minutes he would unwind the deal. We again asserted that we can not and will not send wire payment without front and back copy of title. Kevin called the shipper and told him the vehicle was stolen and tried to reroute him back to Cats Exotic. Q: How does dealer A (Global Motorcars of Houston) steal a vehicle from dealer B (Cats Exotic) if dealer B signed a release for the vehicle to be loaded and shipped? *The shipper informs us he picked the vehicle at a residence, not a business location. We called Kevin after our first conversation to try to work out amicable payment arrangements. He said the title was locked up in a safe and Roy would not be able to send copy of title until Wednesday. We said Wednesday would be fine and we can wait until Roy returns on Wednesday to work out the details of our transaction. Kevin was not satisfied with our reply and hung up. Tuesday December 5, 2006 10:00am Kevin called the demanding to speak to John, Joel, our comptroller, any one of our Sales Rep. for payment on the vehicle. He made harassing statements to our receptionist every hour demanding payment. We again spoke to Kevin explaining that payment on this vehicle is not possible until we receive a copy of the title. We did not expect him to send us the actual title, just a copy of it. This was not an unreasonable request. Around lunch time, two officers from Stafford police arrived to our dealership stating Cats Exotics had reported the vehicle stolen. After showing Stafford PD our documents, Stafford PD informed us that all of our paper works was in order. No criminal act has been committed. The transaction was legal with supporting documents. We were issued a case number. We were also told by Stafford PD to contact Kevin and inform him that his harassing phone calls are to cease immediately and if Kevin had any questions he needs to contact the Stafford PD. We have overnighted to Kevin the case information given to us by Stafford PD. As the day progressed, Kevins actions became even more unreasonable and threatening. He told us that even if we were to send him the wire, he will never send us the title because he now does not want the deal to go through and does not want to deal with Global. From our prospective, we are doing business with a dealership in another state whom we have had no prior relationship with. The shipper informs us the vehicle was picked up at a residence, not a dealership. The representative from the dealership tells us that we are to immediately wire him funds without the vehicle actually being in our facility AND he refuses to send us the copy of the tile. How do we know HE didnt steal this car and is trying to SCAM us for money?? We did not feel safe to wire him the funds because if he was trying to scam us, he can take the money and run. Global Motorcars would be left without a title, without a vehicle, and without $297,000.00!!! Wednesday December 6, 2006 Cats Exotics faxed over the copy the title with NO reassignments and a Lien release date of 12-05-06. Someone from Cats Exotics called our dealership informing us they have reported the vehicle as stolen. At 7:00pm John, the owner of Global Motorcars, receives a phone call stating that our prospective buyers for the vehicle are in hand-cuffs, sitting on the ground next to the vehicle accompanied by Houston PD officers and 8 squad cars. Thursday December 7, 2006 Question to all dealers who are reading this thread: How would you feel if you found out that your customer whom just purchased a $300,000.00 vehicle from you was arrested falsely and in hand-cuffs, on the ground, being accused of driving a stolen car?? Neither John, the owner, nor Global Motorcars will lower ourselves to the mudslinging that this obvious small time supposed car dealer has initiated. We will let our team of lawyers do the talking for us. In closing we would like every one to know that if they should like to know any further details to please call us at our MULTI-MILLION DOLLAR FACILITY and we would be glad to answer any reasonable questions. People need to know that there are GOOD, HONEST, CARING individuals in the high-line car industry, and anyone who has done business with us in the past will vouch our good standing. WHY, when this AM.......if YOU truly wanted the car and TRULY had a sale 'IN HAND" did you not complete the sale when I offered to you the HARD TITLE and the car this morning VIA the PD, AT A DISCOUNTED RATE to show for 'Our Both misuunderstanding"? After ALL the GOAL was and still is to make the CUSTOMER HAPPY......? Your response AS RECORDED in WRITING was, "No here have the car back" You signed releases to this with the PD. AFTER it had 120 more miles on it. Seems to me if you truly wanted to make your customer HAPPY, you would have completed this offer this AM.....? REALLY A SALE?????. 1. I guess being friends with you clients is not allowed anymore. 2. These customers have purchased over 1.5 million dollar worth of vehicles from Global in the past several months. Their decision to conduct business with Global obviously is based on the trust and faith they have in our company. 3. No police officer would make a comment about anyone joy riding in a car when they were, by your own words, parked in their house. 4. Joel (Global Head Buyer) spoke with Roy at least five times on Tuesday and Roy knew and instigated everything that occurred subsequently. 5. It is pretty weak to blames things on an employee who was just doing what theyre been instructed to do. 6. Roy, how can you have a title in your safe on December 1st if the lien release date from Chase Bank imprinted on the front of the title clearly states December 5th? You can not stop making yourself look bad! You still dont get it. People who know the facts and the ins and outs of how dealerships operate know you are lying. We at Global Motorcars hope the retail public can also see through your BS. F.Y.I. Actually our floor is less than 2 million . We paid for most of our inventory with our own money.
In view of the resolution announced in the other thread (which I am glad to hear about), is there any reason to keep this thread open? It seems that continuing to take positions over the issue by third parties (me included) is now pointless and counterproductive....
