What guns do you have that are not registered? I have some pistols: a 357, 38 & 22. What does it take to make them “legal”? I have no idea what their history may turn up…

I presume you are in the United States, but even then the legality of the firearms you own would depend upon where you live and how you obtained the firearms.

Given that treading wrongly in this arena can be felonious, you may consider consulting an attorney who knows your local laws if you have questions after reading the laws.

A great place to start would be ATF's State Laws guide. The BATF publishes it in regularly updated format at: http://www.atf.gov/publications/firearms/state-laws/30th-edition/index.html

Most state publish their laws online anymore. Here in Oregon they are online at: http://www.leg.state.or.us/ors/ You can find your state laws with a simple seach on most search engines.

The National Rifle Association has a general compilation at: http://www.nraila.org/gun-laws/state-laws.aspx That may answer your questions.

There is nothing you have to do. There is no such thing as a gun registry on the Federal level, it's actually prohibited by the Firearm Owners Protection Act of 1986. Machine guns, silencers and destructive devices are different but that wasn't really the question. Assuming you aren't a prohibited person (felon, drug abuser, etc) it's completely legal to buy a gun from another private party in the state you live in. Nothing more you have to do.

Some states like California require registration of some types of guns, those who wish to exercise their second ammendment rights live their at their own peril.

The idea of a registry is something that gets talked about a lot by ignorant people or by those who are pushing for gun control.

As for the history of your guns....

Well if you bought them from some kind of shady gang banger that you think might have stolen them then you have a problem. If you found them in a bag down by the river you might have a problem. If a friend gave them to you after committing a crime with them you have a problem.

If you bought them at a gun show or from a classified ad... It's probably not a problem. Lots of people buy and sell guns through private party sales every day. There are something like 300 million guns in the US of A and the vast overwhelming majority have no "history" of any kind.

The 38 belonged to my grandmother & sat in a drawer until she died. The S&W Masterpiece 22 my father had forever. The Ruger Blackhawk was given to me as a gift from a former boyfriend – no questions asked. As you can see the original purchases were many decades ago.
I want to sell the Blackhawk for something not a single action cowboy gun. I carry the 5-shot small 38 in my car sometimes. Then there is my grand father's well-worn S&W 38 (pix)...

    Nothing to worry about then.....

You have a few options. The easiest is to take it to a gun shop and see what they will give you for it or what they will trade you for it. This will get you maybe half to 2/3 what the gun is worth. Second option is to take it to a local gun show and walk around... People will ask you what you have for sale and you can negotiate a deal. Third is to just put an ad in the local major paper. In a lot of states there are now local web boards where people buy/sell guns. Finally you could just see if there are any people at work or wherever who are into guns.

In general you will get the most for a private party sale and a gun show would be pretty easy. Go onto gunbroker.com and see what equivalent guns are going for and price it accordingly. From there it's really just a cash transaction... You can't knowingly sell it to a felon or other prohibited person (google it if you are worried) but apart from that there isn't anything complicated.

Be prepared to negotiate.... A lot of guys just like to haggle. If you price it reasonably you should have no problems selling it.

I personaly would never sell any of those guns unless you need to pay bills or need more crack.

Karen you do not need to "register" the guns. Go to Outside Dog Gun shop in Rincon, tell Pat i sent you. He can list the Blackhawk on Gunbroker, or he may have something you want. Be careful carrying a handgun with no permit. GA is an open carry State, but you need a permit to avoid a hassle with the local LEO's who panic when they encounter a legal firearm.

Common used Blackhawks sell for around $350.00 retail. Early guns and rare variations sell for more, as do guns with original boxes and papers. Expect @@@ $250.00 trade at most gunshops.

I have...... "several" Blackhawks. :) :) so I know a bit about them.

ps, your timing sucks, i just sold and original box for a S&W .22 masterpiece for $90.00. If you had that box with your gun, it would have made it worth much more, even if you did not want / need to sell it. Its like having all the Ferrari jack and tool kit crap with the car. :)
