Can a cop force you to take a breathilizer test even if you werent disobeying any laws? Long story about this
That's really up to 'da Judge' to decide but with an alarming frequency the po' lice opinion rules above all in court. Considering your age I'd assume that this question had to do with an intoxicated minor.. My non-expert opinion would say that getting off on a technicality would be the best bet. Did he have any reason to test the individual involved..? Breaking a law isn't always grounds for prosectution, it could be disorderly conduct or suspicion that brings it to that. Questioning a cops judgment will open many doors. But the answer to your question is no, they can't FORCE you to take a breathilizer test. But they can force you into the back of the car and MAKE you take a blood test at the station. By reason, an individual who wasn't guilty would have nothing to fear, right?
exactly why i took it. I didnt drink last night but as i was leaving a party they were pulling in so we left then he floored it to get me. He called me drunk and i said "I resent that implication!" Didnt realize how funny it sounded when i said it. I was so nervous.
It seems like this should not be allowed? Where are our lawyers on here... have there even been any court cases about this? Sobriety checkpoints where they pull you over and breathalyze you without cause? What country are we living in again?
I learned the hard way last night No DUI for me, but we went into downtown Denver for a party and when leaving coming out of town I was coming down this hill, going about 15 over (50 in a 35) BAM! Right around this corner was A whole group of cop cars just waiting to pull people over for speeding, DUI, kerfew violations, etc. Yup, I got nailed.
Would you want a bunch of drunk idiots driving around and have no cops to be found? I wouldnt, its an safety measure to save lives.
Yeah, twenty cops sitting in one spot the whole night is much more effective than them actually driving around. I saw a few people get busted but the majority were just waved through. I also saw a cop run past the checkpoint on the wrong side of the road at about 70mph.. Glad they're keeping the roads safe!
Well, I guess you are right there, but...they were all hanging out right by the entrance to a highway, not just some street (4 or 5) I preferably wouldnt of wanted them because then I wouldnt have a $130 ticket to pay. But regarding on whether or not they should be there in the first place, I do have to agree with the sobriety checkpoints.
