I need a referral to an Attorney that specializes in "Eviction & Unlawful Detainer".

Basically, a close friend is going through a divorce and her ex-husband has not paid her the monthly support payment for this month, and she supports her two kids without his help for now.

She is now two months behind on her rent, and is being evicted. She just started a new job, but won't have the rent until three more weeks. (Working two weeks, then get paid on the third week). She received the unlawful detained posted on her door, for the payment for back rent and legal fees.

She showed the building manager the offer letter, but he still proceeded with the eviction (that's understandable from a landlord standpoint, to cover himself legally).

Can someone recommend a good Attorney who can help delay or postpone her eviction?
She lives in the Irvine/OC area.

Since you pay employees full bonuses and all outstanding invoices irrespective of circumstance, why not loan her the dough yourself and/or call the sate bar for a pro bono firm.

Not too many lawyers want to work for promises.

Have her answer the complaint and use the standard "Uninhabitable" box or that she never received the 3 day notice to pay or quit or she wasn't served (if a process server did it then that one doesn't work). and then request a court date. The courts are so backed up you are good for at least 3 months before she gets into court. And then it's about another month before the sheriff comes out.

    Gents,

She is willing to pay for the cost of the attorney if it's a few hundred dollars, but she can't afford to pay the 2 months rent at this time.

So, can anyone recommend an attorney?

this is where my head is at too. is she a good friend and is she good for it? if so, have her write you a couple of checks and date them for deposit on a date acceptable for you both.

Exactly, help her out instead of spending money on lawyers.
Being a landlord of a couple of rentals, and having one tenant evicted, I can tell you
it will show on her credit report, and when she rents elsewhere it will show and make
it difficult to get a rental.

Spend the lawyer money going after the non paying husband, not the landlord.....

The other thing is it sounds as though she only got the 3 day notice and if that's the case, Uzy, your loan will easily buy her enough time until she can pay the other month and keep the landlord from filing the UD.

Give her the money, Uzy, after all you said you do it for people who aren't even your "Close friends".

Hey Uzy. I agree with this answer. Unfortunately I'm on the landlord side, so I don't have a tenant attorney recommendation.

You are her friend, why go straight to lawyering up when you know she really owes what she agreed to on the rent and you can fund that for her?
Is this a case of wanting something for nothing?

    Well said

How much is her rent? This sounds like no big deal to help her Uzy... Unless you you are talking about $10,000 per month for a Newport Coast mansion. I can tell you how to tangle the owner for at least a year but it will be against my business ethics... Give her the money and end it today.
