HELP! Car INSUANCE question

    Luckily this didn't happen to me. As a lover of all cars mid-engined I have an MR2 Turbo and a (very young) fellow owner had this happen to him. He lives in California. I've spliced together the post for relevant information.

    Looking for the best plan of attack for the kid:

    “Stopped at a flashing red light signal and was rear ended hard by a guy driving a lightning with no license or insurance. The registered owner is now contacting her insurance to see what's covered. She says she wants to settle without insurance.

    The police came to look at the car yesterday. Still no call from either the driver or the owner of the truck.”

    (At this pint most of us were telling him to contact an attorney)

    “John. I haven't called your attorney or any other attorney yet. I feel embarrassed to say that my father will not let me at this time. I tried to tell him not to wait and let a professional do all the leg work, but he insists that it's still to early to call for one right now. So far I got an estimate from two auto body shops that both say the car is totaled and would cost in excess of 6K to fix it. I also have gathered a police report that clearly says the other driver was at fault. I contacted my insurance company and they pretty much said "since you have only liability coverage, we can not help you with anything unless you were at fault and you needed to pay the other party." I did get the name of the insurance company from the registered owner, but I'm skeptical that it's a real insurance company. According to "Time Insurance", they only will pay for the damages on the Ford lightning and not my car. This sounds really stupid to me because I thought it was the law to have at least liability coverage. I feel really stressed out right now because things seem to be not moving fast enough. Since I live at my parents house rent free, my father constantly reminds me that he will kick me out if I don't do whatever he says. In this case, I have to keep waiting”

    "All he could say was "I pay for everything. I pay for everything." I still haven't heard from this idiot. Right now I'm dealing with the owner of the truck. "

    "I hope the insurance company they gave me was not a fake one. I found a Time Insurance online, but I don't know if this is the one I'm looking for. I just don't get why their insurance company told me over the phone that they only cover the truck”

    More time goes by…

    “John I talked to Robert (the attorney). He told me that since I don't have any bodily injuries there is no guarantee to get himself paid from the case. He did offer to charge a hourly fee if I did want to pursue a lawsuit. I believe going that route may only increase the amount of money I have lost so far. I also found out today from my insurance company that the other party really has no insurance after all. I guess they just got temporary insurance just to get the truck off the lot. Well, I'm going to try to call the truck owner to see if we can work something out.”

    As I've said he's a young guy and has never had to deal with anything like this before and unfortunately it doesn't seem as if his family is helping matters. I'm sure he's more than a little overwhelmed. Let me know what you think.

    Can you post a link to the original thread, please? I am totally confused by the he/she/they/your/mine stuff. Maybe if I read it in context I can figure it out.

    This is why you don't drive without collision insurance. He opted to take the chance and lost. His only option is to sue the owner and driver of the truck. Small claims is probably his best bet even if it does not cover the entire loss. No attorney will take the case on a contigency.

    Even if he does win all that he will get is a judgement which he will then have to collect on his own. If the other driver/owner has no assets you are SOL. I would contact the officer that investigated the accident and insist that he now issue a ticket for no insurance. If he won't then go to his supervisor and on to the DOT.

    The rates on insurance have dropped recently, especially on collision with some companies reducing by as much as 15% and offering incentives to switch to them. If you can afford the loss then take the chance, otherwise purchase insurance or don't gripe about it later.
