Hit by an uninsured motorist!!

    Last night I was involved in a minor accident while going home from work. A guy didn't realize that traffic had slowed down in front of him and lost control of his vehicle while trying to stop. In the process, he bounced off four vehicles (including mine) before finally coming to rest. After the police came and gathered all of their information, we found out that the driver didn't have insurance! That burned me, but what really got me fired up was the fact that the police officer let the guy get back in his van and drive down the road again!!!

    I called the police department and left a voicemail with someone trying to find out why the guy was allowed to get back in his uninsured vehicle and drive down the road. I'm hoping they call me back, but I'm also hoping someone on here can shed some light on the topic for me. The incident occurred in MO, where it is obviously illegal to drive without insurance.

    One of the four vehicles hit was a local news van, so I guess if the police ignore me I can always call the news station and ask their opinion.

    If the guy can't afford insurance, I guarantee you he has zero assets. Your insurance will pay you, hike your rates, and NOTHING will happen to him...

    People who have nothing to lose, know it...

    Can anyone from the insurance biz chime in here? Farmer Dave?

    Do you guys actually chase down deadbeats, or is it just a write off? I often wondered about the details of this...

    In Aust, you can drive without insurance. That allows alot of bums out on the road. We have compulsory "3rd party insurance" which covers you for physical injuries in the event of a crash to the other motorist, but NOT damage to their car or yours.

    I had one guy go around a 2 lane corner with me, he was slightly in front of me in his lane. He was speeding in the loose gravel on the road they had just laid and he sprayed my Ford Fairlane with rocks causing lots and lots of stonechips to my paintwork on the front and passenger side. He did not have insurance. He caused $3K worth of damage to my paint. Do you think I have seen him again.........A little while after, he left town. :mad: Scumbag f*cker!! Every dog has his day. He will be back one day.;)

    In CA(and I'm sure other areas) insurance can't raise your rates for damage done by and uninsured motorist. And, I believe in CA the guys car would have been impounded.

    I can't even see reporting this to my insurance. The damage to my bumper was relatively minor (scraped up the corner), but it's a painted wrap-around bumper on a Jeep Grand Cherokee, so the whole thing would likely have to be replaced. The Jeep is 6 yrs old, so the out-of-pocket deductible on my policy wouldn't be worthwhile to me.

    I thought his vehicle would have been impounded here in MO too, but that wasn't the case last night. I'm anxious to see what the local police dept has to say. I'm sure I'm really high on their priority list today (insert tons of sarcasm here).

    Maybe I'm the only one who understands what you're saying.

    Guy causes an accident and has no insurance. OK, that happens. But then the police let him drive away in an unisured vehicle. That definitely should not have happened. You are absolutley right to ask why, and keep after the question.

    That vehicle should have left the scene on the back of a wrecker headed for the impound yard, and the driver should have left on foot. Why that didn't happen is a VERY good question. Don't stop asking.

    For what its worth, not all states require auto insurance. For example, Wisconsin does NOT require it...at all.

    Tx requires proof of ins for drivers license, registration and safety inspection...illegals and po white trash buy a month's coverage and cancel right after.

    Here, you're out of luck if hit by uninsured, and yellow pages and daytime TV are full of "abogados" who habla espanol looking for those hurt in "accidents" or by "negligence"of any kind...auto, medical, construction, retail store falls...

    MO does require insurance though. That's why I don't understand the police letting an uninsured motorist drive away from the accident site, knowing the guy doesn't have insurance.

    Getting him to pay up is like getting blood from a stone, the only way that will happen is if he gets beaten with it. I'd take him to court, put a lean for repairs & your all legal fees. Even if you win, it will be a tough time getting your money unless the Judge sells off the other person’s property.

    You guys are correct about the no insurance law in Texas, they will impound vehicle but that is only Dallas County. Tarrant County has yet to put that into effect, I don't know why but I wish they would Just think if Harris County passed something like that? More than half of Houston would not be on the road. (I can dream, can't I?)

    How is that going to happen? The guy doesn't have any $$ and his van is a total POS that I wouldn't take if he gave it to me. He's a loser that knows how the system works. I'd just be throwing good money after bad.

    Guy was passing a truck and trailer in a double yellow line as I came ofer the hill. I managed to not get hit head on but he did about $10k worth of damage to my Boxster. He was under the influence, and then produced an insurance card that was fake. His license had already been suspended and the car was in his wife's name. He ended up going to jail, but his wife had her license suspended for not having insurance, nad my insurance co filed a lien on her property to recover anything they could which could not have been much. My rates did not go up but they did "encourage me " to settle to a dollar amount for injuries and then sign a waiver. FWIW, the repairs never showed up on Carfax.

    Second, I agree with you in not pursuing this legally. And to the poster who said that "you can't let him get away with it" the follow up with the Police department might help, especially if you involve the news crew, in terms of going to his house and impounding his car.

    Third, in Oregon, if you can't produce proof of insurance (even if you have it) your cars is impounded.

    I hope it is a wake-up call to be sure you have as much UM coverage as you can afford. Statistics show as much as 40% of the cars on the road at any given time are uninsured and 80% of the remaining 60% are underinsured. And, almost all of them are judgement proof, i.e., broke. As a PI attorney, I see so many people seriously injured by uninsured and/or underinsured motorist who have no or minimum UM coverage. UM coverage is very inexpensive and the most important auto coverage you can buy IMHO. Call your agent now and be sure you have at least $1mil in UM coverage...I have $5mil...

    does your state have a uninsured motorist fund? maryland has it. everyone pays into it. i once was hit by an uninsured person and the fund covered my damages.

    That sucks man. I thought that MO required you to carry uninsurred or underinsurred coverage? We always had it. I understand about it not being worth while to try and get anything from him or your insurance though.

    If I were you I would go to Andys and have an Ozarks Turtle, then I would go to Mexican Villa and have some cheese dip and a Sancho Enchilada style. That would make me feel a lot better. Maybe I would do Andys after MV...

    Wow, you're obviously familiar with the area! The combination of Mexican Villa and Andy's is hard to beat. You even managed to nail my favorite dish on MV's menu, the coveted Sancho Enchilada style!

    Did/do you live in the area?

    I do have uninsured motorist coverage, so that's not an issue. The damage to my vehicle is so minor though, that it's not worth filing a claim through my insurance company.

    No...in Georgia it is up to the individual motorist to buy their own UM coverage. What are the limits of the UM fund in Maryland? Will they pay you millions if you are left crippled by an uninsured motorist?

    Mexican Villa, the least authentic Mexican food on the planet but still something I crave...

    I lived in Springfield for 5 years. My wife is from Willard. I like Springfield, its a decent sized city with lots of small town feel to it.
