I have the deposit not Mr Norwood. It was my commission. These are the pictures that we sent to the guy. Mr Norwood talked to him on the phone and told him this is how he bought the body, subframes and wheels from the factory. There are also pictures showing which car they came from I am posting. The car was a 288 GTO prototype then turned into 2 different 288 GTO Evolutions then to an F40 prototype. So it's not like he didn't know what the car looked like. There is also a picture of a car from Ferrari GTO automobilia on page 46 showing a car with the same rear end as we have that he questioned

Commission for what? Taking a deposit on a deceptive and misleading ad? Holding the guys deposit after admitting the error? You should have your head examined. I for one hope you keep coming back posting week after week, shooting for 100,000 views.

Is Norwood even aware of what's going on here?

    Now it all makes sense!

You misrepresented the car, and now don't want to hand back the coin.

You just keep digging that pit for your employer Norwood deeper and deeper.

Give back the money, it is not yours.

Oh boy, are you ever wrong. :D

It's br95's because it's, "His commission" on the deal.

    Um, er . . .

Well, maybe he did perform a service of a sort, he's let us all know what kind of "service" you get in a failed transaction with Norwood. The commission? A lifetime of trying to get this thread off the front page of any internet search for Norwood.

I just keep thinking, "What am I missing, could it be this cut and dried?" The whole "three sides to every story" keeps rattling around in my head. Then I read another post from bigred95 and decide, "Nope, no missing pieces."

This is the thread that just keeps on giving.

    He has to be.
Perhaps he's turned over sales to Bigred and is either too foolish, stubborn, arrogant or perhaps even mentally failing to realize what has happened.
Seems bigred has a death grip on somebody's two grand.
My advice, Bigred; don't spend it all in one place, your salesmanship leaves a lot to be desired.

I was not part of the original deal so I did not get commission from the other sale. And we had the car sold to the guy he just hadn't put a deposit on it. He had already seen the car. The fact is we still get new business every day so it doesn't matter what you guys say it's the point of Mr. Norwood is known well all throughout the Ferrari world

So, now you're a lawyer, too? Whoa! Well, back up the bus, then.

However, here's a little free legal advice for you: truth is a defense to defamation claims.

You can't go around calling people retarded or anything else like that because one day you will do it to the wrong person and they will come after you with a lawsuit. I may not be a lawyer but I have a great one I can call.

It's good to take a step back and try to look at this objectively. But I think you're wrong in saying that people are joining the mob, despite having no facts about the people involved or the case. The way BN and bigred have represented themselves through this, has been less that a stellar professional performance to say the least. Add to that the fact that both seller and buyer have agreed upon what was misrepresented. To me at least, this look to be quite clear cut.

I think what also get so many people out of their seat in this case, is the sense of arrogant and "No F's Given" entitlement bigred and BN shows.

Sure, they had to spend some time on it - so what. That's part of doing business.

Then they claim they keep the money because of the time they spent, which turns out to be a commission to an employee of BN Autocraft. Eeh, okay. So what bigred is saying is that basically the few hours he spent on this is worth something along the lines of 2-3 weeks pay(pure guess) on top of what hourly rate BN pays him? Riiight.

Then of course there's the simple fact that BN sold the car quickly after the OP walked from the deal. Sure, if BN et al had lost money on the car and/or had to turn down a dozen customers, then it would make sense to make a point of getting compensated. Same if the car was NOT misrepresented, which it was. However, BN Autocraft made a quick sale and still felt it was right to keep the "deposit" from now on referred to as bigred's commission.

Oh, and let's not forget the fact that when BN Autocraft did find a set of original rims, they bumped the price up. This makes it a completely new deal in my eyes and the OP should be in the right to say whether or not he was interested. Funny thing here is that BN Autocraft and bigred claims that it was OK to raise the price of the car as the wheels were more expensive despite the fact that the wheels they found was what the car was originally supposed to have. And what about considering the fact that the aftermarket wheels they take off have some value of their own? Nah, that apparently does not matter to BN and bigred. Again, this despite the fact that bigred admitted in this thread that is was a mistake on his and BN's part to say that the wheels where OE, when in fact it was only the knock-off's.

At the end of the day, the admitted misreprentation of the car in itself from the seller, makes it a pretty clear cut case. And trying to make the buyer pay more because the seller has made a mistake or keep the deposit, eer sorry, commission, just screams "low ethical standards".

How can you blame people for voicing their distaste on a matter like this where some of the involved parties acted as poorly as they did?

I agree completely and 100% that we have to be careful about how the web and our forum is used. I know there have been more than its share of threads here from disgruntled buyers and sellers over the years, that should never have seen the light of day. But this is one case where the web and our forum does its job so to speak.

If that's the case, this whole thing is even more bizarre.

Now I'll give you a little free life advice. It's called the first rule of holes: when you find yourself in one, stop digging.

Go ahead and call your lawyer. Go ahead and sue to your heart's content. You'll spend tens, if not hundreds, of thousands. Then, assuming that you can establish that you have been defamed, you'll have to show YOUR quantifiable, reputational damage. You just stated the following:

"The fact is we still get new business every day so it doesn't matter what you guys say... ."

That statement against interest totally undermines any damages claim Norwood might possibly have. Alternatively, maybe YOUR personal reputation has been damaged. In which case, show the quantifiable harm. I rather doubt you can.

So, while the Internet threats are always fun to ponder, you might not count your award for damages just yet.

    Just my $.02.

I think Bigred is the first one to use the term "retarded" here.
Better watch out, he's got $2k for the retainer

The arrogance and ignorance is just mind-boggling. You've come to the largest online Ferrari community in the world, made an ass of yourself on multiple occasions, helped get a thread making your employer look like the Grinch onto the top of Google search results for his business and you don't think it matters? What color is the sky on your planet there sparky?

It's like there is a boat adrift somewhere with a captain on the bridge drinking champagne and a madman running around below decks chopping holes in the hull with an ax.
