How FU Can a Garage Project Get?

    Ok, so they are 3 months behind. But were they cut away the roof it has leaked H2O down the wall inside the house, swelled up the back door so I can't open it, etc. Also where they cut away at floor level it has flooded my study & ruined not only the carpet but some books, atlas, etc that can't be replaced. Now I'm really pissed. What can I do? I signed a contract for the job but what about all this damage?

    squeaky wheel gets the grease.

    I'd start squeaking like you mean it, and after all of that, you should. they should be amenable to a deal, take some pictures.

    I disagree, If they are not going to take care of the problem immediately, send tham a certified letter. Send them notice that you will terminate your contract and tell them exactly why. Tell them not to come near your property. If they have tools and equipment on your property tell them they cannot retrieve it until you have reached an agreement. Demand the name of their liability insurance company, call them and raise hell. This is the reason that we have liability insurance anyway.
    If anyone needs legal help make them make the first move. Make them accrue legal costs. You don't have a thing to worry about as long as you are right and the contractor is liscensed and bonded. If not you will never get a dime out of them. The courts are very sympathetic to a poor old homeowner that got screwed by a contractor. If the contractor is on the up and up you can get results without paying a penney in legal fee's. If they are a fly by night outfit you may as well chock it up to experience because you cannot get a cent out of them. In my area if a contractor does not have a city business liscense, they are for legal purposes not in business. Therefore city codes and laws do not apply to them. I know this from experience. Make sure all corespondence is in writing and well documented.

    Please e-mail me the name of the company you're using. I just started getting quotes to have my garage remodeled and I don't want to use them! The only advice I can give is to look to the terms of the contract first to see what remedy is specified in such a breach. Then, put him on notice that he has X days to complete the job or you will terminate the contract and hire someone else to complete the job and look to him for any cost in excess of the original contract price, ie cover. If he then refuses to pay, you're only alternative is to sue him. However, a lot of contractors have few to any assets and it becomes almost impossible to collect any judgement you get against him even after you win. That being the case, depending on the amount involved, it's usually better to sue him in Magistrate Court to avoid having to pay attorneys fees. Good luck.
