    Recently there have been some copyrighted images posted and the owner's responded pretty upset I think I would be as well. If I take a picture is it copyrighted to me? Do I have to file something? If someone posts a copyrighted picture but gives credit to the owner is it illegal?

    I believe you have to file something. Also if you load it up online, isn't it fair game. i mean it seems like it would be pretty hard to track someone down. But just to be safe I would give credit to the person

    I know you are talking about me... I have mixed feelings about this subject.
    There was one post where someone photoshopped two of my pictures. I thought that they looked horrible after he altered them, but the main reason why I had them removed was because he supposedly owns a photo retouching business. Who knows what else he might be doing with my pictures.

    I give people permission to use my pictures all the time. I just don't like people altering my pictures without my permission. They are photographs, not renditions...

    The person that takes the photo has the rights to it.
    To further protect your interest, you can send a copy of your pictures to the U.S. Copyright Office. I also use a copyright notice on most of my pictures...

    Do a few searches here. I've explained this several times in response to similar questions. If you snap the photo, the cr is yours. You don't have to file anything to claim it, nor do you even have to affix cr notice (the C in a circle legend with date and claimant name) to establish rights. But, if you violated somebody's privacy by taking the photo, your copyright would not be a defense to an invasion of privacy/publicity claim. Unauthorized copying and display is still infringement even if you 'credit' the copyright owner of the work you posted. There are defenses of 'implied license' to download, and possibly to repost, but those have not seen much court attention. Hope this helps.

    Yeah he has a great profile pic! But Mike it wasn't just your picture it also just happend in the enzro register thread last page check it out. Thanks Mr. Hart for the post. Now I remember you posting on the subject before (even on the old board) I should have searched.

    Thanks, Red. My secretary actually set up the computer at my office to do a bunch of ip related symbols and shortcuts with the push of a button- there, i cannot type a (c) without getting a ©.
