    ... ask a female employee to wear her hair up the next day? Now I'm not a fool. I told her I wanted to see if she was just as hot with it up as she was with it down. Everyone knows that the hair up adds more than with it down.

    I guess I'm asking if I'm in trouble?

    It's only harrassment if they get mad. Make sure and give her a raise. The law requires 2 parts. The act and the financial part. If she's not hurt in the pocket book I don't think she has a case.

    You need to keep quiet at work.
    If you are her boss then you should get in trouble.
    Thats the way it is now days.
    I guess people were tired of being abused, so the laws are starting
    to reckonize employees feelings.
    Every case is different, so its best to stay profesional.

    If this is your business, it's a real stupid thing to do. If you are a manager and she works for you and you both agree to split a sexual harassment judgement that she files against your company for your actions against her, then go for it!

    Honestly though everyone takes everything to damn seriously nowdays. You say one damn thing and it's sexual harassment. I'm glad I work with cool people or else I'd be having sexual harassment charges brought up against me from even the guys I work with everysingle day!

    That's the worst thing to do!!! Then all she has to say is "look he told me he would'nt give me a raise if I didn't sleep with him so I had to". Either way it's not good at all!!

    The big question is does she work with you or for you? If the answer is for you then you could be in BIG trouble already. If it's with you then have fun!!

    For a simple comment to be considered harrasment it has to be "unwanted" and the victim needs to voice their displeasure to someone (unless it is painfully obvious, like "hey, I wanna f**k you?".

    As for the act, that in and of itself could have set you up for major headaches!

    Depending upon whether or not you are her boss or co-worker will only determine the amount of the settlement if she decides to pursue a complaint. Assuming this is a first offence then you would probably get off with a slap on the wrist and a warning. If not then get a good attorney.

    If you are asking "Is this harrassment?" then you and your company need to get educated on what constitutes "harrassment" in 2004. Trust Me!

    Therefore, "I told her 'I wanted to see if she was just as hot with it up as she was with it down'" could be construed to be friendly advice on ways to keep cool during Summer... even in Eastern Canada.

    Obviously, no matter how hot it is, if you'd suggested she take her clothes off, that might not give you as many "outs."

    This ****ty thing here is....it's not for you or I to say!! Unfortunately there are no diffinative defentions of sexual harrassment. If she feels like she was sexualy harrassed, well then, she was.

    As far as I know however, there has to be ongoing advances for it to hold up. I think witnesses, or at least some sort of record of it for it to hold up anywhere.

    I don't think what you said was anything wrong. She should be flattered that you give a ****.

    Why screw around with the hair? Next time just ask her to undo the third button of her blouse. Of course this is sexual harassment. You're asking a co-worker to perform an act for your own sexual gratification. The simplest question to ask yourself to determine whether it's sexual harassment--would you make a similar request from a male co-worker?

    Besides, I didn't do it in the pooper so it's all good.

    Update - she may be leaving the company, on her own free will of course. Could she have taken advantage of me? Love me then leave me? What a whore! Can I sue her? I feel so dirty.

    P.P.S. If any of you work or know someone that works at ExxonMobil, tell them she hurt my feelings and they shouldn't hire her.

    She was harassed. You did it. Is her position subordinate to yours? If so, duck and cover.

    I'm assuming she's already made some kind of noise at you otherwise you wouldn't be asking.

    The rules are simple. Any action that causes someone to feel uncomfortable in the workplace, or has the potential to make someone feel uncomfortable, can be construed as harassment.

    If I say to you, male or female, "you look nice today" I'm on the potentailly ratty edge. If I say to you, "YOU LOOK HOT TODAY!!!" I'm over the edge. If I say, "YOU LOOK HOT, AND YOU'D LOOK HOTTER NAKED ON MY DESK" then you are way over the top. (some small pun intended.)

    Similarly, making remarks about sexual orientation can cause a world of trouble. So can a remark about weight, what person eats, who they associate with, the list goes on and on.

    Emailing dirty jokes around the office, displaying porno on your computer, all this and more can be construed as sexuall harassment.

    The simples rule is, "DON'T BRING IT UP!!" and NEVER, EVER DIP YOUR PEN IN THE COMPANY INKWELL. Supervisor or subordinate, it just leads to trouble.

    AND remember, after work, same rules more or less apply. Any work function, same rules apply.

    This particular instance would probably only result in a note in your employment jacket with us, and a warning that doing it again would result in your being dismissed. If the woman in question insisted she couldn't work with you, you'd be out on your arse, following a discussion with you about your behavior, and your apology to the woman in question.

    I know, it sucks, but that's just the way it is now.
