    Sounds like they might be looking for excuses to get out of a contract early or not pay their rent based on my experience.

    Yes it is similar. She is moving out and asked the landlord to prorate january. Landlord replied he would think about it and give an answer back the following day. ( tenant is moving not before the 23rd of january..). Tenant then says that landlord gave verbal agreement and is now bound to prorate...

    I am not surprised. This is the kind of thing which i hated about working in property rentals. I suppose it is up to the landlord to stick to his guns or take a hit, i dont know how much the rent is (nor do i know your legal system) but he might just be better off swallowing it and moving on as it could be a pain to try and recover the money. People who do these kinds of things often fabricate extra reasons why they should not pay, for example should a threat of violence not be handled by the police? I cant see how the landlord can possibly be at fault unless he owns the other property and has not taken action against the other tenants despite complaints. Do you have a deposit? If so can you take the money from that and refund the difference?

    I am not the Landord. He is a friend. He has the security deposit and most likely that is how he will get his full month of rent back. I know the tenant and she was all nice and all. My friend was more than friendly to her, letting her move in with a dog before meeting her, trusting her etc. They became friends and now she does this crap. I saw some emails she is writing, it just makes me want to slap some maners into her.

    This is why we do EVERYTHING in writing even telephone agreements are followed up in writing. If it comes to he said/she said, probably won't hole up in court. However, who wants that problem. Sometimes it is better to let them go with a bit of money in their pockets.

    FYI, I don't evict anymore. I'll offer $500 cash if they are out in 5 days and no damage to the property. Believe me they take the cash and go. That $500 is what it cost me to go to court, so IMHO, it is a win, win situation.

    People can be strange, as i said i have experienced this kind of thing before as an agent. I really went out of my way to help a lady out once who also had a dog. I am a dog lover and will usually stroke any dog i see but this was a huge mean and nasty looking rottweiller that i never wanted to go near. I went on an arranged appointment (after she had not been able to afford the rent for 3 months) to meet her to look at some damage, she was aware that i was coming and that i would let myself in with a key if she was not around, in which case the dog would be out or fenced in the back garden. I went straight upstairs and looked out the back window and saw the dog dart in through the back door. She had propped the door open on purpose knowing that i was coming around :eek: I have never left anywhere so quickly, if that thing had got hold of me i would have been in serious trouble.

    BTW thats a good idea Johnny.
