Legal tee shirts with regards to Ferrari and 308

    Hey all,

    What's legal with regards to printing tee shirts?

    Just looking to print some up as souvenirs for myself, family and crew for the Ferrari event in August at Laguna Seca.

    Is it pretty much illegal to print the word Ferrari? Would it be okay to print something with "40th Anniversary of the 308" on it with an image of the 308?


    With regards to images, etc. I recall some nonsense about Porsche getting litigious about anything printed that resembled a 911.

    I figured there might be some Ferrari factory/FNA reps at this event and really don't want to ruffle any feathers.

    Ferrari, 308 and any image of a Ferrari that includes ANY badging that says Ferrari are TM restricted.

    I think if it's for personal use (you're not collecting a penny from anyone for these, making a few for friends, etc) it's UNLIKELY that FNA will land on you. But they'd be within their rights to do so.

    I foolishly ASKED in advance to FNA for permission to use the word Ferrari in a fund raising T-Shirt. They politely (I mean that) said, "No."

    So, my experience is limited, but Ferrari is protective of the name, the images, the logos, etc.

    Ferrari, like any other brand, has to jealously guard its service marks/trademarks in order to keep them.

    I think you can use a picture or drawing of a Ferrari or but not the logo itself as we did in our 308 poster for the Pennsylvania Concours d'Elegance. However the use of the horn and key fob are okay. By the way I have posters available, pm me if interested.

    Your Porsche example might be a special case. Porsche has trademarked the "turtleback" shape of the 911.

    At the same time - all major brands tend to heavily guard their logo's and trademarks, for financial reasons. If a phrase gets too commonplace, they can lose the trademark I believe.

    What about all these independent shops that they use the word Ferrari on their owning together with other car brands? Do they get an authorization from Maranello?

    As in, "we repair Ferraris" that's not the same as calling it "Joe's Ferrari Shop."

    1st is ok, second is not.

    But remember that there are 100,000 other, more important TM infringements that keep Ferrari busy every day.

    Bring it to their attention, and I'd bet the guy would get a cease an desist notice, otherwise, they are flying under the radar.

    Based on my experience you can use an image or drawing of the car but you cannot feature their logo or trademark.

    Ferrari have been very successful in protecting their various logos, and script used to spell out Ferrari.

    FCA had to go round and round on the logo and how & when it can use the prancing horse... we cant use the Ferrari script or immages of the cars for advertizments etc... that is why the old FCA logo ( red background with Ferrari nose badge ) went away.

    if you contact Ferrari they will categorically deny you permission to use:

    the Ferrari name - or script
    prancing horse
    scudetto - shield or rectangular badge
    Scuderia Ferrari in any form
    or - any immage / facimile of a Ferrari car - even if its your own

    for any commercial purposes.

    however - i think it would be costly and time consuming for them to come after everyone who is doing this. Cavat emptor.

    The horse with a raised tail is a trademark. It is an inaccurate representation of a rearing horse.

    The Ferrari script with the long F extending to the "i" is a trademark. The word Ferrari is not.


    They will tell you when asked not to use anything but they can only legally enforce so much.

    The clubs and independent businesses have been through this many times.

    I have a couple of old tattered 308 tshirts from long ago. Would love to have a couple more as these are almost threadbare. :)

    The concours replaced the one that use to be held in Reading Pa, We had about 100 Ferraris registered and 90 show up and having it at the Simeone was very nice too!, Barry
