    Süddeutsche reports that Montezemolo told a group of journalists in Maranello that if Bernie is indicted in the Gribkowsky affair, "he will, because he loves F1 so much, be the first one to take a step back, in the interest of F1".

    What I (and the newspaper) mean is "Montezomolo says that if he is officially accused of bribery and has to go to court, he has to step back" - is that what "indicted" means? Or does "indicted" already imply being found guilty by the judge? If the latter, I may have to ask for a second correction of the thread title :eek:

    I suppose that I have a quite strong bias against Bernie. As everybody is innocent until proven guilty, I´ll rephrase the question properly:

    If found guilty, will he go to jail?

    If Bernie is found guilty I would be very surprised if he served "Hard Time" or any jail time for that matter, his money and connections will make sure of that. If he did it would be at a resort for rich felons where they play golf and tennis and eat S&T and not SOAS. He could also just recieve 'house arrest' at one of his mansions and run F1 from his inner sanctuary.

    I don't think he'd actually go to jail - we can hardly ask the UK to extradict one of their citizens if he just stays there. However, a court ruling sentencing him to jail isn't impossible IMHO.

    The driving force behind the whole case is the Bavarian finance minstery, with the finance minister Söder at the helm, which controls the Bavarain state bank (BayernLB) Bernie dealt with. Söder has already cleaned the house there, yet no one of the members of his party who were involved in the whole mess around the bank faced any serious trouble.
    Söder is under immense political pressure at the moment for other reasons, one must not underestimate the influence the governing conservative party has on the courts here in Bavaria, and there are elections next year.

    The single best thing that could happen to him now would be a big success (= jail time) over a prominent figure like Bernie. The finance minister fighting for the taxpayer and succeeding over the evil guy whom everyone thought invincible - this is exactly the kind of press Söder needs, and he's exactly the kind of guy for stuff like that. Oh, and it would convienently let everyone forget his attempts to keep his party colleagues out of trouble.

    I really think a bad punch in the face for Bernie by the Munich court is entirely possible.

    Why I always write "LdM"...... ;)

    I'm sure there'll be a lawyer along shortly, but I *believe* (could be wrong :eek:) that one indictment may comprise many charges related to the alleged offense(s). The indictment details said charges that the authorities are going to try and prove in court.

    Being indicted doesn't imply guilt. [Outside of the prosecutors at least - They wouldn't bring the charges unless they feel they can win.]

    I think? Please correct me if wrong!

    Interesting times indeed. TBH, as much flack as we all direct his way I actually hope this goes away - It could ruin an already "dodgy" legacy, overshadowing everything he has done and may even kill the old guy. Unlikely, but he is now what, 82, 83?

    Firstly, thanks for the insights Florian - Very interesting hearing "from the horses mouth" as it were.

    Isn't that exactly what they'd do? I assume (always dangerous!) there's all kinds of mutual "cooperation" between all members of the EU?

    Hope these guys - no doubt all very sharp politicians - know who they're taking on here! Bernie will fight - he's never been one to roll over - and I could see him taking them all down with him if they're not very, very careful.......

    IMO if Mad Max had to resign for tarnishing F1's name by being kinky, Bernie should definitely resign for being involved in financial crimes.

    MM's exploit's were proven via video yet not illegal. Bernie's situation is quite abit different as it is a legal matter and he has only been accused and yet to be proven guilty, a huge difference.

    That's my point. People were calling for his head, when he did nothing really wrong. It was embarrassing for his fetish to come out for him, but it had nothing to do with F1.
    Now if Bernie is involved in corruption not related to F1, it would be no different. Both of them are "dragging the sport's name through the mud", because all the tabloids start with *F1 Supremo XXXX* or *F1 top Honcho XXXX* or *FIA Prezident XXXX*. It doesn't matter if you put Mickey Mouse after the title.
    Now I don't necessarily agree with all this, but that is what got implied when MM video broke out. The fact that the case in question involves not just corruption, but corruption directly connected to F1 makes it even worse.
