VERY unclear area of the law.

Most on point case is Intel v. Hamidi. It is, by many accounts, THE most important tort case in a long long time.

Basically, fired employee from Intel sends mass emails to employees there saying how Intel sucks. Intel tried to use a theory of trespass to chattels - i.e. is imposing on the use of Intel's property (namely, their server.)

Intel lost.

There are two camps in the debate. One is Epstein - who I have heard says he wouldn’t have argued this as he did in amicus brief; he would have argued that this was more like trespass on real property – he was using real property to disseminate his message. Would Epstein say you have to have some notice? Probably.

The court basically said he’s wrong, that this would have a silencing effect on free speech, that it would limit the productivity of the NET, that it would limit the NET’s technological usefulness.

Why not have a rule – free access unless you’re told not to? Is the policy about right of access, or talking about protecting companies from spammers? Is Hamidi using the resources of the company? Yes, probably at some level. But it’s not enough to find liability. Epstein says that if you have strong property rights, then you have to pay for it or something. And the spammers incorporate this into their costs. Counterargument is that we want freedom, and that cost to society doesn’t fit into this model.

There is some suggestion that the court would be able to stop Hamidi if he kept spamming after the decision, but on different grounds. Bottom line is that you probably can't sue someone under a trespass to chattels theory for bombarding your server with emails or pms. But this is still highly questionable.

The general bottom line is that it's a very unsettled area of the law, probably one of the largest emerging areas, and one that the Supreme Court hasn't really decided how to address. (And probably won't for at least a few years.)

 

I've gotten two (ultimator and allmondo). Even this jerkoff knows I am one of the country's best drivers with balls of steel.
