    Hi,

    Has anyone had issues with not receiving goods from Mr Fiat?

    I purchased some 330 rear light lenses, side markers and door handle gaskets in early February, as listed on ebay and paid in full at the time of order. After a few weeks with no arrival I contacted them and was told they had none of the items in stock and it would be 10 day before they arrived at Mr Fiat. 10 days later it was still not in. I emailed them yesterday and the reply was....yes you guessed it 10 days until they come in.

    Has anyone else had issues and more importantly did you ever receive your goods?

    Now the icing on the cake.... I bought a tire holddown of ebay from them on a Buy-it-now auction and have paid them via paypal the buy-it now price.

    I promptly got an email saying they wanted another $200 USD for it plus shipping!

    They can't do this surely? The buy it now is a fixed price. When I complained they sent me a list of their terms and conditions stating they have the right to change the price of their goods.

    Any armchair lawyers out there that can offer advise. They have all my money and I have no goods, plus they are holding the tire hold down to a $200 ransom.

    I feel your pain. I have not dealt with them, but must say that the buy it now price is a "fixed price listing" for a reason. They surely cannot ask for an additional $200 AFTER the sale has ended and more importantly, AFTER you have paid them.

    Open a Paypal case asap, as you only have 45 days to claim. That's if Paypal play ball and decide in your favour. I hope you manage to resolve this.

    Thanks Ryan, I am looking into it, but as in your case paypal resolution sucks and a little bad press may resolve the situation in our favours.

    The tire hold down was cheap, but my point to them is that if it was a "buy it now" we both committed to the price. They committed to ebay when listing as you have to review and confirm before ebay lets you list an item, and I committed to the price and paid in full.

    This terms and conditions list they sent me saying they have the right to change the price is worthless.

    What do others think?

    I've ordered a fair amount from them. Have never had an issue, although they do seem to sometimes order stuff from their supplier when you order it, so sometimes there is a delay. As to the ebay additional fee, they can't do that, even if they listed it for the wrong amount, if it truly was a BIN auction. I would just get on the phone with them and talk it through. Ask for David Besharat.

    Thanks Albero, but it is David that wants more money than the Buy it now price of the ebay listing. When I refused he sent me the message below.

    If you look at any of their auctions INCLUDING the buy it nows on ebay you will see these T & C which basically say they can change the price of the winning bid, even the buy it now price.

    This is just ludicrous.

    I have had good results with PayPal on the rare occation of problems with a seller here. Italy is another story.Italy has always been shakey and things today are worse. There are enough dealers in the USA and countries like England who can get you the parts you need. Let them worry about the overseas shipping. Yes it will be more expensive but they are hear, speak English,and are much more accountable. When having to deal with ??? "luigi" try a couple of small orders first and see how they do. tongascrew

It is very sad, that in this time and age, a small business such as ours with almost a 100% positive customer satisfaction rating has to endure and become victim of the mendacity of a customer who is upset that he could not take advantage of an honest mistake.     Last week we added 8 new items in sucession to our ebay store using a specialized program for bulk ebay listings:

    Ferrari 275 330 365 Spare Tire Hold Down New $204.00
    Ferrari 250 GT Spare Tire Hold Down New $204.00
    Ferrari 250 Spare Tire Hold Down New $204.00

    Unfortunately, the person with the task of listing these items on ebay, by mistake of their own or the program, listed the Ferrari 330 GT GTC Spare Tire Hold Down New for -$4 instead of $204. Literally within minutes user Darren C purchased and paid for the item. We then immediately refunded the user his $4 and explained the mistake, at which point he explained his intention to pursue this matter legally. It is very unfortunate that such a trivial situation has turned into an slanderous ordeal.

    1. I purchased multiple items from Mr Fiat back on February 13th and paid at the same time. I phoned them from UK and got exact shipping charges which I paid over the phone via my card. Fedex or similar express service USA to UK

    At no time did they say they actually never had the items in stock that they had listed for sale.

    2. After 3 weeks I asked for a tracking number as the parts had not arrived. I was told they were out of stock and would be in stock in 10 days then dispatched.

    3. After multiple emails every 10 days for the last 8 weeks I am continually told the parts would be in stock in 10 more days before dispatch.

    4. In the middle of this saga I saw a tire hold down for sale in a buy it now auction for $4. Since I was already waiting for parts to be shipped I honestly clicked the buy-it-now and paid. I had no idea what other items they had on the auction or their price. I was using an advanced search on items up to £100.

    5. This was a honest genuine purchase.

    6. David emailed me requesting $200 more on top of the buy-it now.

    7. I was not happy, so he emailed me the T & C and said I didn't have a leg to stand on legally, as they reserve the right to change the price without notice.

    8. The rest of the Mr Fiat's post is just a smoke screen as they cannot explain why they listed 3 other sets of parts for sale in February, (newly listed, so they should of had stock) took my money and didn't actually have the parts to sell.

    David, as you have posted on this thread can you gracefully explain the above events in reference to my missing items that I paid for in good faith please.

    They have $500 of my money for parts they did not have to sell.

    The buy-it-now ebay issue is just a small part of this fiasco.

    This is a serious problem, and I'm sure if it happened to you you would be equally annoyed.

    In my book once you hit that buy it now button both the buyer and seller have entered a mutual legally binding contract and both are obliged to follow through with that exact transaction

    Yes this is the oldest scam in the book. It's known by a few names such as "fishing". A victim is lured into a sale with a bargain price (the hook) and signs up. Then when it comes to pay they are presented with unreasonable T & C's or small print to boost the price they owe. If they kick up a fuss then they are discredited as a fool who wants something for nothing.
    I mistook the safety of an ebay buy it now auction to protect me from this sort of scam.

    If Mr Fiat is so genuine and sincere I would like him to explain where my items are that I have paid $500 for, and if they are a genuine business why do they consistantly decieve customers into parting with thier hard earned cash by offering goods for sale that they simply do not have?????
