    Steve, this Fchat thread: http://www.ferrarichat.com/forum/showthread.php?t=86701 has a running debate in which several newbies claim that Naples Motor Sport negotiates on price...while a couple of Fchatters like BH1 and myself (who actually tried to buy cars from Naples) keep pointing out that they *do not* negotiate on their advertised price.

    If they negotiated on the sales price with you, someone who clearly wouldn't be biased towards them, that would help end that debate.

    If not, then please add your sales experience to the above thread.

    Another thing I noticed, he said he paid somwhere in the 191,000 range, now after ripping him off for another 8,000.00 they have the car listed for 194,000 and supposedly its sold. No wonder they can afford to have the same cars sitting there for 6-7 months. They have had the orange gallardo for coming on 4-5 months.

    That was exactly my thought, except I would have told any potential buyer about the paint work in whatever ad I placed to sell the car. I don't need the $ badly enough not to tell the truth. Besides, in this case it would be hard to hide!!

    Steve. I'm sorry that you went through this experience. I keep a list of dealers that I will NOT deal with, in any way, shape or fashion. Naples has just been added to that list. There are always two sides to every story, but your's has the scent of sincerity to it, and usually dealers like this one have more than one horror story connected to them. If the many members of this sight took the time to send these companies a quick email letting them know they are 'off' the potential biz list.....they would soon mend their ways. My email is heading off to them asap.

    I've been careful NOT to defame them here. Just told the story, and posted the pics, along with a link to my website for larger, clearer pics. I could care less if they sue me. That would be kinda fun, although I don't know what they'd sue me for. Suffice it to say that if they do, I'll post all the info about the suit on this Board, as well as my Vette Forum, and the Lambo Board.

    The impotant BBB, along with Consumer Affairs, Florida DMV, and the FtC will be receiving my complaint later in the week.

    Thanks for the heads up. I was going to give them a call regarding the 348 Spider I saw on their site, now I won't bother. I'll keep searching via the private sale route. I had almost talked myself into using a dealer, for peace of mind, and this thread has shown me that a dealer cannot be relied on. A $16,000 "restocking" fee is absurd.

    Thanks for the post concerning this shabby dealer. I have been looking for a 360 spider and this thread was an eye opener. I for one would have demanded all of my money back, or sued. They would have settled, as they had no grounds to demand the restocking fee. Lesson learned: go see the car before buying it, find out who owned it before, and get in touch with them if possible..have the car ppi'd by a reputable entity, and buyer beware. I aleays check the feedback on EBay before i even talk to anyone advertising a car for sale. I wonder what theirs' was.

    I will also add to my list of banned dealers I will not deal with. It's about 80 miles from the condo and I like to car shop while down in Floirda. I am totally sorry for your dealings. Buying an exotic should be a great experience! Keep us posted!!
    I'd go after the restocking fee.

    I'm not a body repair guy, but I have a couple of observations to make on your pictures:

    - While it's obvious that the front bumper was resprayed, the drips at the front of the car are most likely not from the factory as there also appears to be a "drip" that's resting on the bumper top edge. So the drips are the result of a respray at the front; and the bumper and body were resprayed at the same time.

    - The pictures below show that Ferrari use a state-of-the-art painting system with robotic spray guns, so drips are highly unlikely. Also, the bumpers are not sprayed at the same time as the body shell.

    - The "two-tone" line also seems to indicate that the front of the bumper was not re-sprayed. This is curious because if the re-spray was ostensibly for stone chips, this would indicate otherwise.

    - The overspray of the the color coat on the black seems suspect, too. From the picture below, you can see that the bare chassis is sprayed with the color coat all over. As a result, this would imply that the matte black finish in the engine compartment (and front trunk, etc.) is sprayed on after the color coats.

    3. The truth is your defence against defamation: however, how much money do you want to spend in order to tell the truth.

    I feel for you and you seem like you more than operated in good faith, but I have to question why you did not seek out a lawyer to set them straight?

    I've seen folks get hosed time and time again by some unscrupulous car dealer, then pay the money to have the car returned or worse, keep the car. I've had my own experience with a brand new 911/997 Porsche that was a lemon. Dealer treated me like a leper until I got tough and brought in a lemon law lawyer that not only got me all my monies back, but got me a check for an additional $10K for my trouble.

    The best part of this was that according to lemon law, I didn't have to pay a penny to the lawyer. This was covered by Porsche dealer, that did the wrong.

    Sadly, these guys will now have doubled their profit margins on this car, versus learning a hard lesson for bad business. Instead, as you indicate, the lesson was yours to learn and cost you a chunk of change to learn it.

    Again, glad to hear your now back on track so to speak!, just wish the outcome was a bit different and as powerful as we'd like to think these discussion boards are, they represent about .001 percent of the buying public for Ferraris.

    Just a few observations:

    1. It's a used car for 190k, so it would had been in your best interest to had it inspected by an independent 3rd party instead of just taking the seller's word on it. You wouldn't buy a house without a house inspection.

    2. Your position that it's the sellers legal obligation to disclose any paintwork maybe hard to prove since it's very difficult for a selling dealer to know of any pre-existing paintwork if they were not inform by previous owner.

    3. A painted front bumper is not the end of the world, it's typically a annual maintenance item for well driven f-cars, stone chips are inevitable.

    3. Naples is wrong in not honoring the money back guarantee. And the GM is a dishonest person for not disclosing the items.

    Not siding with anyone here, just making a few points.

    Seems like the list of reputable dealers gets shorter and shorter every month, especially here in Florida.

    Personally, as a former business owner, I would have bent over backward to help you. I guess some businesses feel there are enough replacement buyers out there that pissing off one customer is no big deal.
