Need some quick quick legal advice!

    So a girl I have been dating is 20. Last weekend she was at a bar with her sorority and called me up to come meet me in the French Quarter. She had been assigned to pass out a pitcher of beer to various kids at the bar. So she put the pitcher down and walked out of the bar.

    After making it to the street an undercover officer stopped her and took her ID and directed her to go back into the bar(the bar is 18 to get in). She and about 40 people then received a Minor in Possession of Alcohol ticket because the police were raiding the place. Pretty lame since she wasn't drinking herself and was just doing what the sorority directed her to do. Anyways, obviously not an excuse, but here in New Orleans we recognize that bars pretty much do not care about 20 year olds having a beer.

    Anyways, this girl has never gotten into any trouble before at all and was freaked out about the whole thing. Now has a court date and the ticket to deal with. I know with a lawyer she will likely have to pay the fine and then some, but usually the ticket will disappear from her record.

    She is a great girl and I told her I would ask you crazy folks for some advice for her. If anyone of you have any advice or know of someone who can take care of something minor like this please send me a message or let me know what you think!

    Thats typical of New Orleans... Multiple people getting murdered everynight but lets put the cops on raiding bars for 20 year olds drinking and raiding massage parlors. Quick tell NOPD there are Jaywalkers on Common and St. Charles. Better call out the swat team for that one.

    Please clarify something for me...Where exactly was the officer? Was he in the bar & followed her out to bring her back in because they were raiding the place? Or was he walking down the street, spotted her leaving the bar, and decided to hassle her? Did all of her sorority sisters under the age of 21 get a ticket? You said the place allowed 18 y/o to enter (I am familiar with these kinds of bars), so how did they know who was breaking the law?

    The reason I am asking is this: Did he actually SEE her with the beer? Did he actually SEE her consume any beer? Or is he simply speculating that since she walked out of the bar that she must have been doing something illegal (ie drinking???).

    If he simply saw her leaving the bar and decided to stop her, then he may not be able to prove that she actually ever was in "possession" of alcohol or that she consumed it. I am willing to bet that she can find a way to challenge this thing and prevail. Man, there are a TON of questions that need to be answered before I can help you help her get out of this BS....

    Let me know EXACTLY what happened. I may be able to help her out, for a small fee....lets say a 12 pack of Miller Highlife and the opportunity to meet a couple of her sorority sisters!!! :) - I am a CHEAP litigator!!!! ;)

    Tell me about it. When my house was broken into and burglarized in July it took the officer 30 minutes to arrive. I called my roomie on his phone and he rushed home from work to get to the house. On the way over he got pulled over for speeding by the traffic division of NOPD.

    I asked the officer why it took her so long to get to my place when there could have been someone inside. The answer? She had to work a traffic accident because the traffic division was busy setting up a speedtrap on Earhardt so the other divisions of NOPD had to take up their slack!!!

    Talk about absurd. And it wasn't the fault of the officer responding to my call, it was the way the traffic division was goofing off giving tickets on a section of Earhardt that sees little traffic.

    One of the reasons I moved to the French Quarter was because response times to 911 calls down here are amazingly fast.

    Raiding a college bar and setting up traffic stops that force other divisions to pickup the slack is nothing more than a move for revenue generation. So it isn't necessarily the fault of the officer as much as it is the higher ups.

    I was just surprised that my girl was forced to go back into the bar after she had already left the premises.

    I'll PM you in a bit. She is going to a sorority meeting in a few and I'll be able to find out if anyone else in her sorority received a ticket for the same infraction.
