New car purchase laws in TX

    A vehicle was purchased that had $5,750 in rebates but only $3,100 show on contact, agreement was $8,900 off msrp but in reality is $3,100. Sales guy stated that all rebates and incentives have to be given to customer but that obviously didnt happen here....Only been 5 days so what does the laws say? I negotiated the deal on phone but between us hanging up and finance it was all changed, also found out they added a $2,000 service contract that she stated she didn't need many times.

    This was my friend's first new vehicle purchased and feels like she was taken advantage of because she is an inexperienced 24 year old one year out of college.

    I have worked for a few Toyota dealership's in the past (not in sales but service) but I know how they work so I would either talk with the sales manager/owner or just get out asap. Most are snake's and your phone negotiation gave them the advantage.

    The car can alway's be dropped off and letting them know they are being reported, stand your ground is basically what I'm saying.

    I didnt know if there was a 30 day or 7 day period where you could take the car back if you had issues, the sales manager pulled the old say one thing but do another trick on her...

    There might be a DTPA claim or the like, but contractually if she signed all the standard documents that itemized all the charges, she probably owns the vehicle. Hate to sound callous, but a 24 yeear old college grad should have been able to do the arithmetic to see if the deal was as she was told and either say "fix it" or "no deal," not sign something materially different from what she was told or expected. She will have a tough time if she signed a standard purchase contract.

    Now if there was paperwork sleight of hand, different story.

    As a practical matter, have a lawyer or other person with some presence go back and confront the owner or GM and tell them that you'll ahve no choice but to sue unless you can get this sorted out and they might back down.

    Just got home from dealership, the $2,000 service contract was removed without question and additional $3,150 in additional discounts was added which they claimed was just an oversight :rolleyes: . Was much easier than I had anticipated with no resistance from them at all, I thought it would get ugly but it never did.

    They new they were in the wrong......Simply trying to take advantage of a young lady.

    At least they were decent enough to make the adjustments...alot of stores would say "you signed it, you own it!"

    Good deal. Tells me they have been busted in the past and really did try to pull a fast one. Life lesson unfortunately for the young lady. Pity dealers can't just be fair. Oddly the higher end makes never seem to try this crap in my experience.
