New DWI penalties in NY

    Effective August 15, 2010, New York has new and enhanced penalties for those convicted of DWI. Leandra's Law mandates that all defendants convicted of Driving While Intoxicated under specified subdivisions of the Vehicle and Traffic Law and Penal Law, be required to install an ignition interlock device on their vehicles. Specifically, this means all vehicles driven, borrowed, owned or registered by the defendant. The interlock device must be in place for at least 6 months, but a Court can order a longer period. Driving a vehicle that is not equipped with the device, during the specified period, is a misdemeanor and will result in another arrest and additional penalties. The bottom line is, do not drink and drive. It’s not worth it.

    As I was sitting in court this morning listening to defendant after defendant sentenced under the new law, I thought how great it would be to have that contract. Good for you.

    the problem is that more and more people were getting plastered and then go out and kill somebody , then getting right back into another car after over- drinking again, thats the problem with the world today , nobody gives a crap or values somebody elses life, + its this stupidy that makes lawmakers go to this extreme.

    agree , tho I always have said and I am sure millions would agree that along with written permit test ,and vision test there should be an IQ test given to all drivers obtaining a new or renewing a license IE ( THAT DUMB ASS DRIVER IN FRONT OF YOU WHO HAS NO CONCEPT ANYONES BEHIND THEM AND SLAMS ON THEIR BRAKE OR DOESNT SIGNAL NO BRAINS ) ...Ther are safer drunk drivers out there in my opinion !!

    just jack the price of alcohol way up.
    If it costs $60 to get plastered every day - instead of $8 - you can bet a lot of this problem would go away.

    Of course, this is tongue-in-cheek, hypothetical, in-a-vacuum speaking, but someone has to think outside the box...

    They call it DUI (Driving Under the Influence) in the land down under (Australia).

    By the way, what happens if the perpetrators wife or acquaintences want to drive the affected vehicle(s) ?

    The answer to DWI is to build a device on every car that prevents drivers from driving the car when they are under the influence. We mandate airbags and all sorts of stuff but not this. The interlock device is too obstrusive. There are other devices under development that monitor pupil dilation, alchohol in skin, etc.

    I agree, but then you make tampering with the device a 10 year jail sentence and a forfeit of half your income.

    If you're driving correctly, you'll be far enough back to react to such situations. Sounds like you follow too close in traffic, a common problem many people have. Many accidents would be avoided if folks like you would just back off a few more feet.

    The ones we have in NC do that. You blow into the thing and if you are over a predetermined limit, the car either shuts down or will not start. I think it is generally set that you have to blow at start and ever 30 min there after.

    Personally, I think it is a great idea.

    While they are at it, they should make a device that blocks the signal from cell phones while the car is moving.
    I am more concerned about the idiot texting, than the guy who had a beer with lunch.

    Maybe mercedes-benz is working on it.
    That commercial which highlights how the new MBs can automatically stay in a lane and come to a full stop by themselves makes MB drivers look like inattentive morons. It's comical.
