    Honestly I think this is useless, first and foremost because the community already condemns reckless drivers.

    I really hate this when things are auto-regulated and governing bodies are so bored they have to make new useless rules. Couldn't you just let things be? Cops already bother everyone enforcing BS rules (not all laws are BS, just some of them) ... and now this community joins the funsucking in acting like cops. Great. It's not like a bunch of friends anymore.

    First. I think this Internet policing BS and monitoring is going to get worse. I would humbly suggest Mr. Lay move the site to a server in another country and register it in a way that he can't be sued. Russia for instance. No libel laws and certainly nobody is going to be knocking on your door for gloryfying fast/drunk driving.

    Second. On a drugs forum I know, whenever somebody wants to tell of a drug related story that he is a potential partaker he says SWIM (Somebody who is not me.) I.e. as if it happened to somebody else, maybe it did!!!

    Third. I think glorifying reckless driving is stupid, but it is possible to talk about it without gloryfying it just like it being possible to talk about race relations without it being racist. That's what moderators are for. I am sorry, but the current rules are kinda vague. I don't want to surf Ferrari chat with a lawyer at my side. This is not even close to right now and I understand the reasons, but it's a slippery slope.

    Fourth maybe the solution is to move all this content to a Subscribed section?????? I mean we discuss some really hot/potentially very upsetting topics there and I don't remember have ANY meltdowns or transgressions.

    P.S. I haven't driven faster the 170kmph or 110 in like 3 years and my max daily speed 98% of the time is 50-60mph, so I am not a reckless driver myself.

    P.P.S. What about us European drivers????????? I mean on my recent trip to Italy...erm... some "dude" who was driving my car was always driving 150 in a 110 zone... only to be by-passed by Granmas in Fiats and Cops like he was standing still. Can I not talk about this "dude" (who is not me... honest).

    I love Fchat and support this new policy wholeheartedly. In fact, I would put the following at the bottom of each of my posts if I could afford it (that is a hint for a free Rosso subscription upgrade :D).

    I'm not one to post about reckless driving as my car is too slow, but the word "glorifying" has me scratching my head. I would hope people who violate the rule get some warning. I could tell about once or twice I over estimated the ability of my car to stick to the road, but saved it through my driving skill. If I did post a story like that, am I glorifying my skill or showing how stupid I was to think I was in an F1 car?

    When I have more time, I'll try and explain the law in more detail, but the concern is creating a forum for activities that may encourage users, however misguided, to engage in reckless driving or worse. This is not about the first amendment. Here's a link to an article that I found in a quick search that will give skeptics a little background. http://www.publaw.com/negligent.html

    Although websites enjoy additional immunities under Section 320 of the Communications Decency Act, it is my understanding that an exception may be claimed where the ISP is itself participating in the offending conduct. I'm not saying I think F-Chat should or would be liable in such circumstances, but any lawsuit costs money to defend, regardless of the merits.

    For what it is worth, the "Hitman" case discussed in that article was, at the time, dismissed on first amendment grounds. However, the Court of Appeals reversed, and remanded the case for trial. The opinion addresses some of the first amendment issues raised here.

    No, it's not. We have all seen video posts of outrageous driving on the internet.
    People are interested watching those videos because they are not a Sunday morning drive, they are outrageous and dangerous and peak some peoples interest.

    "On a drugs forum I know" Great, that is the place you like to go ? Fine, that is a forum for that purpose. Each site is allowed to reasonably regulate it's content.

    In your profile you list your interests as "...porn addict, sky diving..." I'm sure there must be an offshore site for skydiving porn addicts.
    See, the internet has something for everyone.

    Is child porn legal in Switzerland ? It isn't here.

    Interesting point. The fascination that some have with how fast a car is in a straight line IMO doesn't have much to do with Ferrari's or Lambo's for that matter. I always thought sports cars were about winding roads.

    I speed (usually hit over 100) every time i take my car out. so do most of the guys in the mid atlantic. I advocate it and talk about it. when a website that is a forum for discussion about a car that was designed and is bought for driving over the speed limit bans talking about it, that is ridiculous. are you trying to tell me there is someone on this board that hasn't driven their ferrari over 65mph on the public roads? what a joke. This sight is being taken over by nannies and the worst part is it's pretty arbitrary how it's doled out. see you guys when i get back from my ban.

    There places here out West where the posted speed limit is 75 mph (Colorado, Utah, Nevada, etc.). I go over 100 kph on a daily basis and it's legal. ;)

    (PhilNotHill does not condone or encourage breaking the law or cheating in F1)

    Even though America has a long history of breaking the law (civil disobedience) going back at least as far as the Boston Tea Party, one should resolve unjust laws through the legal system, not by breaking the law. Breaking the law is only justifiable as a LAST resort in extreme cases. ;)

    What is the big deal here?

    If you robbed a bank, would you get on here and tell us all about it?

    If you wanted to get a gang together to rob banks, would you post it here, and solicit gang members?

    How about if you wanted to steal a car, or a bunch of cars? Would you post it here? Round of a bunch of folks to do your own version of "Gone in 60 Seconds"?

    Of course not.

    The only difference is the law you're breaking revolves around your cars and a "personal" behavior, so that makes it ok?

    I'd just like to offer the thanks of the many legal minds represented here..rcallahan, whart, msgsobe........and Mr. G. is just a great rational voice in general..

    I. personally, think it's only a matter of time before Internet images are admissable into prosecution..computer graphics and actual photos are easily discernable by experts.....also what few perps seem to realize is there is little way to edit the random details to prevent a positive identification.

    As I said earlier it was a street racing video post here that caused a Law Enforcement effort that STILL has attorneys working to this day! And the tragedies of innocent and involved parties continue.

    Drive safe, drive fast.....do both in the proper environment......
