Everybody wants you to fight, but they don't have to do the work or pay the attorney fees. You do. You should just focus on your other clients and stop wasting time on this. Look how much time you have wasted already. Believe me I know.

I don't think Karl wasted time. This is a good outlet to vent...plus, he spent time on pursuing what's right...that's never wasted time. He just has to evaluate if it's worth continuing. Karl, whatever you decide, there are a lot of people here (including me) that will support you.
You sound like the attorney for the thief. This bully is counting on him quitting just like a long line of people have probably already done . It's like the song says "sometimes you gotta fight when you're a man"

You never know what the outcome will be in court. The last time I went to small claims court was a situation where a patient took the insurance money, and forced me to sue him to pay me. The judge actually ruled in my favor, but cut my bill. Essentially the patient made money because he got paid in full by the insurance company, and then he had to pay me a portion of it. You need to decide if you can live with the pittance he paid you. The aggravation that time out of work and questionable court decisions might make you more upset. I have relayed to my attorney that I don't want to back down. I feel that if his attorney knew all the details he may not have taken the case.
I have had to go after many deadbeat patients who think they don't have to pay for services and so far, I have never lost in small claims court. I make sure my case is in writing and the judge has it in front of him/her. This way the defendant is doing all the talking and usually saying way too much. The magistrates have heard it all are pretty good at spotting the BS. I've never lost, but It is still and pain in the rear and it takes up valuable time to do it. Bringing an attorney into small claims court is contrary to the purpose of small claims court, but it is not prohibited. Usually the limit is $5000 and the countersuit of $7500 may be a way for him to wiggle out. I'll defer to the attorneys here on that one. Another fact is that just because you win the case doesn't mean that you get paid. I always follow through and if they don't pay, I always file the judgement with the county clerk of court. This way, if they ever try to sell their house, you have a lien against it. I got a call from a closing attorney because the guy was going bankrupt and his house was being foreclosed. A judgement is like a secured loan. I was able to collect the amout of the judgement as well as my expenses and several years of interest. That almost doubled the amount but it took a while. Any updates on this situation??? Sure woulda been nice to wrap up some nice roadkill (dead animal), with a pretty bow, and leave it at this a-holes front door. He would have opened it up this morning to find such a sincere gift !!!! Perhaps next year....
Carl works on my cars--mine, my wife and son. He is a genius. He is honest and he does great work. I stumbled onto this site and saw this. I have seen the car and I have heard the voice mails on this issue. The ferrari guy was incredible. He left these messages to Carl stating flatly that he was not going to pay. Some of the things this guy said were just stupid and asinine. My law license is not SC, so I could not help him, other than to give free advice. But I will tell you this. Carl did not exaggerate at all. Just to tell you a little about Carl--I was stuck at the airport on a SATURDAY. I called him about my Mercedes which would not go into gear. Carl came out and jacked up my car. He fixed the problem and then took the car back to his shop and made sure the fix was permanent. Carl has a passion for cars--he has gasoline in his veins. And, he is a damn good driver. He has several national awards for driving. I'd trust him on a track at 150 more than my dad on the highway at 50. If you can give your business to Carl, you will get great value for your dollar. And, the work will be sound and complete. (ANd you can talk cars with him alot.)

So I get a phonecall from a friend yesterday. He owns a Porsche shop in town and asked if he could bring a 911 by for me to scan with our Porsche computer. I told him yes, of course. Then he says " Do you remember my friend ****. You met him at the P-club Octoberfest. He was having a spirited drive home sometime this weekend as he saw a black Ferrari approach from behind. Against his better judgement he decided to take the bait. As he came into a corner on an Exit ramp he decided that he could not make it at that speed and backed off. The guy in the Ferrari did not follow suit and lost control bouncing from wall to wall like a pinball. NOW, who do you think that was in the Ferrari. My friend that never paid me for the work I did. The car is totalled. The P-car guy gave him a ride home after the car got towed and my name came up. Ferrari guy tells the Porsche guy that he is taking ERR to court for extortion." I don't want to be mean but I am still grinning. Karl
