    You may remember a few weeks back I wrote to complain about a certain indie based in NW10, and the problems I was facing as regards to mechanical problems(clutch/gearbox/diff) and warranty issues with the 360 modena purchased from dealer.

    After I posted the complaint I called the owner (RL) to discuss my issues firstly with vehicle and secondly regarding warranty I was issued or should I say not issued with when purchased vehicle.

    His reply was that his warranty doesnt cover 1. clutch 2.gearbox and because I had posted the complaint he wasnt happy and under the circumstances he doesnt owe me any goodwill whatsoever

    Fair enough- So I asked for a break down of exactly what warranty covers, this was 3 weeks ago (he said it was in the post).


    Please be aware I have only covered 2,000 miles in the car since ive had it
    And this is a car that cost me £75k.

    I have since fixed the clutch myself via another indie costing me £1200.

    If anybody out there knows anything pertaining to warranties and what I should be entitled to please reply

    (RL) if u would like to repond or better still list details of warranty issued by your firm..

    Clutches are rarely covered by warranty, though most dealers will come to an agreement with you if it buggers up within 3mths and reasonable miles I think.

    Gearbox - depends what was wrong with it I guess. But generally I'd say it should be covered.

    That said, and it doesn't help you now, but two tips:

    1) Always get a car independently inspected, even if (especially if!) buying from a dealer.

    2) Double check all warranty fine print *before* handing over cash to ensure you know the risk you are taking. Many warranties aren't worth wiping your arse on.


    Oh yes...

    3) Always have a scout around for feedback on the supplying dealer...

    In my experience most warranties that are sold/given to you when you buy these sorts of cars are are rarely worth the paper they are printed on.Most of the warranty companies won't even pay a reasonable labour rate and will use absolutely any excuse to void the claim

    By the way all policies exclude wear and tear items such as clutches and brakes.

    I would recommend negotiating a price without the warranty and setting a sum aside equal to the cost of the proposed warranty . I have had some real nightmares with extended warranty policies and steer clear of them as I only need to burn my fingers once

    That may very well be your experience, and I believe you totally, however the total picture is that SOME are worthless and some are actually very good. The differences between the good and bad is massive and the industry is clearly responding to the poor press.

    Autoprotect/Motorplan/Lumleys = VERY VERY VERY low levels of cover, tiny claim limits and exclusions all over the place. But these policies are dirt dirt DIRT cheap for the dealers (note: Retail prices are an entirely different matter!!!)

    Im not going to plug any of the good ones Ive seen, but it becomes quickly apparent if you do a little bit of ground work.

    OK, let talk law for a second here, regardless of third party warranty he has provided, he must still comply with the Sale of Goods Act. There are therefore two entirely separate 'contracts' in place if you like:

    Where a warranty has been provided by a third party provider, it is a separate agreement (aside from the agreement between retailer and consumer for the sale of goods) between the manufacturer or third party provider and the consumer. The warranty is usually only enforceable against the manufacturer or third party provider.


    Forget the warranty for a seconds, as far as his obligations under the Trades Descriptions Act and the Sale of Goods Act, you need to be able to prove that the car was essentially either 'not as described' at the time of sale or that the car was 'not fit for purpose/not safe' at time of purchase. For a wear item like a clutch, the dealer is always going to win that battle (IMO), you have bought a secondhand car, if you wanted to know the clutch wear prior to purchase you should have put it on an SD2 for an estimate, otherwise you are buying blind and neither party have commited to any particular detail regarding the clutch - other than it is not new, clearly.

    Other faulty items (not wear items) then you do have a chance to fight your case with the dealer. He can alway argue that at the time of purchase the car was fine, the 2000 miles you have driven the car have caused the failure. Its a nasty battle to fight, but certainly possible, depends whether you can catch the dealer out lying to you at the point of sale. Or whether you can prove that the component should have lasted during that 3-6 month period after the sale.

    Regardless of you spending £75K on a car or not..... it is a car out of manufacturer's warranty, and all buyers needs to factor that into the value of the car when they purchase it.

    Also regardless of all the legal mumbo-jumbo, most dealers will help you out to try to keep their reputation and keep you as a return customer. But they dont have to, we just benefit from that side of this very competitive industry.

    Taking up disputes with car sales can be a problem if you are relying on claiming that goods are not "fit for purpose".

    There is a point at which you have deemed to have "accepted" the car, and wether it is "fit for purpose" becomes a moot point. Not sure where this "acceptance" occurs, but it left me in a position of helplessness with a car that had spent 30% of it's time in a garage being repaired (9 times). Basically got told tough poopoo by a solicitor..... :(

    Has anyone got any experience of trying to claim on the Ferrari UK Warranty they give you with second hand cars?, as I fear it’s only a matter of time before something goes wrong with my gearbox

    Read the small print of your warranty booklet, and then, if you have any doubts, get in touch with Ferrari UK and explicitly ask whether the part you're concerned about is covered (though it's too late for you to do anything about it if it isn't).

    In fact, even if you're not in doubt call them anyway.

    Examples - suspension is covered according to the booklet on the Power warranty I received. But shock absorbers aren't (springs and wishbones must fail regularly, eh).

    Electrical items seem to be covered (though this is a particularly thorny area), but faulty wiring and sender units (e.g. speedo) aren't.

    It's an absolute minefield, and if you need to claim you can expect delays on answers and arguments all the way. Sometimes it'll be productive (wholly or partially) and sometimes it won't. Roll the dice.

    PS I'd be half inclined to get them to give you a copy of their parts list for the car and tick the items that are covered next to every item, down to the bloody nut and bolt.
