NY ticket questions

    I was driving down from CT and was pulled over by a NY state trooper around New Rochelle He said he got me at 80 in a 55 with radar which I know to be a complete lie because he was parked way ahead of me facing the opposite direction of traffic. In addition my radar detector never went off. I definitely was speeding most likely around 70 but in any event he pulled me over for “80”, completely forgot that I had handed him 4 PBA cards, had 2 decals on my windshield, and a fallen officer plate and wrote the ticket. He actually appeared a little nervous as if he had just started the job, or I was catching him in a lie. I politely asked him several times if the radar really showed 80 because “I didn’t think I was going that fast.” I also didn’t tell him I had a V1 which never went off or ask to see the gun reading. In the end he actually apologized for writing the ticket, but it irks me how he could just lie about getting me with radar. My question is will the points transfer over to my NJ license? I can go to court (1.5 hours away) and talk it down, but if they are gonna double the fine like they normally do then there is no need for me to do so unless points transfer over. Any help would be appreciated.

    It makes now sense that he would apologize for writing you the ticket..... strange. Sorry I am not 100% certain on the points transfer.... I do know that NJ will not transfer if you have a NY lic - so I think the same is true the other way around.

    NY pts do transfer to NJ licenses so you should do what you can to lower the charge. I think the limit for out of state transfers though is 2pts. With a lawyer you're paying for the connection/networking - they have no magical power. In fact if you had access to the prosecutor - which you really do if you're resourceful, though they often don't make it easy - you could negotiate a lesser charge for plea.

    In my opinion at the very least you should make the trip to fight. If the officer isn't there you need to request a dismissal - they don't just toss it if you don't ask.

    BTW when did this happen? If it was today w.the high winds, print NOAA's and another online weather service's weather forecast/current conditions showing wind report. High wind can affect radar accuracy so you can add that in addition to your other notes to impeach the accuracy of the 'reading' if you do go before the judge. You could also get there a bit early in hopes of having a few words w.the prosecutor beforehand.

    Radar units are set up in both directions in the troop car. They can get you either way. Sometimes they also have the laser gun and just need to point and shoot. They also have "radar detector detectors" and know if you have a radar detector in your car. So if this was a new trooper he doesn't want to be caught by his superiors for not giving a ticket to someone who has all of the stickers and cards from the PBA. Did you have a NYSP sticker and if so did you tell him who the trooper was that you know. If not you are toast and you should lawyer up or plead it down.

    All my PBA cards and stickers are from officers I’ve treated at work in NJ so I have no NY connection per say. Im aware that there are guns aimed in both directions, but I highly doubt his gun was on. As per the report it was a radar gun and I would think irrespective of the device he was using my V1 would go off if he tried to pick me up with laser, or any type of radar band. I guess I’ll go to court and see if I can talk it down. In the past I’ve called the officer myself to court and have had it dismissed. I guess well see, I just don’t want any points from this offense! Thanks again guys!

    When was the last time your V1 was updated ......I had mine for a while and my friend had one that was more recent with newer software and his picked up stuff mine did not but in the meantime a traffic lawyer is your best bet. Many here have used Frank Desousa in the past and have been pleased with the results.

    I'm gonna take a wild guess here but just the fact that he apologized may very well mean that he's willing to work with you. Perhaps he is new and felt he had to write you since he alread stopped you, I dunno.

    I received a red light ticket not too long ago in my town (the light was seriously yellow but whatever). Long story short... the officer said to come to court but he was a "no show" so the ticket was dismissed. I know a red light is not the same as speeding but it's still a moving violation/ pts. In your case, I would definitely go to court and at least get it pleaded down if the officer does show up. Good luck.

    Did he give you a print out with the radar model number and the speed and time with the ticket? Just go to court and face it. As it has been said earlier, points do transfer. Good luck.

    Connecticut cops bull**** about your actual speed all the time. I got an 85 in a 65 once and I know I was not going more than mid-upper 70s.

    In NJ, you only get 2 pts. on your record for an out of state moving violation, regardless of how fast you were going. If you want to avoid the points all together, consider contacting the guy everyone on here raves about (Frank Sousa?? if I recall correctly). Do a search of threads for new york lawyer for traffic tickets and you'll find his contact information. A bunch of the guys have used him and say he is really good. Best of luck.
