    Unfortunately it's abused on a daily basis, especially in NY which is a PIP state which is practically a car insurance welfare system. I worked as defense for an insurance carrier handling NY auto injury claims litigation for a little over a year and the NY legal system regarding PI (personal injury) is quite possibly the biggest farce I've ever seen.

    I can't tell you the hundreds of thousands I've seen paid out to plaintiff guys like Cellino & Barnes over what are utterly laughable claims yet they and several orthopaedic surgoens have no issue turning their clients into walking petri dishes with unecessary surgeries. ONLY in NY do you see this level of farce as in any other state this lunacy is laughed out of the court room, and it's all due to PIP coverage and it's beyond asinine wording.

    It's questionable whether this cop would get anything out of the loss just because he's a cop (the jury will be easily stacked with cop haters, seen it happen). His threat of making a claim is quite possibly posturing to prevent any further claim being presented against the department and himself. Either way, I wouldn't want any part of this one.

    This. He knows he ****ed up and is trying anything to lessen the impact. Throw a ridiculous suit at the driver and he may think twice about filing a complaint. If I was the driver, who obviously has money, I would call his bluff and go all in on the suit and embarrass him.

    Yeah? You never know what can happen in front of a Manhattan jury. They may throw a chair at the punk kid with a nasty verdict, who knows! I can definitely see it going either way though. May the best salesman win.

    Even a rhyming jury will see the cop went full-Shatner in the video. They may decide to lay the wood to the kid anyhow, though.

    Even with an Umbrella policy. (or at least mine)

    I was on the cop's side throughout this but now I think they are both idiots.

    You should all take into consideration that the Fcar and driver are now know throughout the police department. There will be future eyes on the street looking for the car/driver who assaulted their fellow officer. Don't burn a cop because they have lots of friends. Just sayin .

    Sorry Jason, I probably shouldn't post this. I found it humorous and sometimes life gives a little back when you are ripped off. I wouldn't be productive if I chased this guy down for the minuscule amount of money. Sorry I upset you.

    Setting aside the minor criminal charge, I don't think either one has much more than a nuisance case at best in a civil action. Two idiots from my point of view. The driver was plain stupid in trying to leave and the cop was overly aggressive in his retailiation.The only thing you could like here was the car and that of course was the reason this was a story ( the girlfriend was nice too).

    Now back to P&R where the real action is.

    Don't be apologetic for a fact. Hopefully this is a atypical event by an atypical Ferrari owner. There are still way too many who view themselves as beyond common courtesy and respect of others.     Bystanders were injured because massive sidewalk planters, substantial enough to deter truck bombing the Empire State building, bounced police shrapnel instead of absorbing it. The rules are that once a gunman has shot off his weapon indiscriminately, he has to be neutralized by any means necessary. Given that the gunman had shot at so many, how many people were in the area, and that they didn't chose the environment, I'd bet that this was a clean PD response.

    $10 Mill Lawsuit against driver of Ferrari by cop who pretended to have his toe run over, after putting it in front of the wheel and then physically assaulting the driver.

    There are many disparities in the world.

    It will be interesting to see the outcome of this case.

    I don't know why the cop wanted to stop him moving. If he had a legal right to detain him he should have told the driver to stop and told him why. If he had no reason he should have obeyed the law and not hindered the car. Putting your foot in front of a cars wheel, when the car is legally free to move (may be the case) is at best a bad idea, worst case entrapment. Next came unnecessary brutality, which you could say was provoked by the foot being run over, but if you look at the video it appears the foot was not run over... in which case its just what the cop felt like the driver deserved for his disrespect of his authority.

    Glad the camera was there... you cant get away with anything now... biggest spy camera network in the world.
