Okay, I have a question. I've been receiving mailers from lawyers in the Dallas area because of a ticket I got on July 11, 2005. The ticket was for "cutting a corner". I paid the ticket on July 25, 2005. At the time I paid the ticket, it had not been entered into the system (2 weeks later). So, the lady I dealt with down at the courthouse entered my information and ticket number into the system, and then took my payment. I thought I was finished with it.

Well, today (technically yesterday) I received two more mailers from lawyers, only this time they were saying that there is a warrant out for my arrest!!!

    A) is this just a scare tactic to drum up business?
    B) do I really have a warrant out for my arrest?
    - and if so, what do I do about it?

I'll reiterate. I've already paid the ticket, even though there was some screwy stuff going on around that too. What do I do?

HELP!! Any advice, legal or otherwise would be appreciated. I realize that everything posted is simply opinion and it will not be considered law. I appreciate any and all wisdom. Thank you.

    Joshua

Yes you have a warrant out. Go down and talk to them and explain the confusion and try to pay for it if necessary. They won't come looking for you or anything.... but if you get pulled over and you have a warrant for unpaid tickets, you will get arrested. Just go down and talk to them and you can pay a few bucks or something and I think they will take it off because of your willingness to cooperate. It's really a comman thing.

If you have a receipt you're OK. I would call the city first, rather than go down there. You don't want to place yourself at the mercy of some possibly overzealous deputy.

Joshua, sorry to hear. Did you get a receipt via USPS mail or email? If not, you should at least be able to verify payment from your bank or cc co. Its possible the payment didn't go through. I would verify that first, then call them to discuss it.

I appreciate the responses, guys. The problem lies here....I paid cash, in person, at the courthouse. Now.....I THINK I have the receipt, but I'm not not completely for sure.

Now, why would I have to pay to have the warrant taken off my record? The ticket is already paid for...and its their mistake. I will call, tho. Thank you for the advice.

You wouldn't have to pay for the warrant.... Their system obviously says the ticket is outstanding... otherwise they would not have issued the warrat. Look at this as a learning experience. Always keep a paper trail, because things get lost. I hope you find that receipt. If not, you'll be paying that ticket again...

Well....I have great news. I just got off the phone with a lady at the courthouse. As it turns out, they had two ticket entries with the same number (mine). No one had put two-and-two together to realize that it was already paid. She said she would have it taken off. I feel much better. Now, I just hope everything gets followed through with. She also mentioned that it takes 2-3 weeks for a ticket to be processed into the system....that's a little absurd, isn't it? *sigh* Oh well...its all taken care of. :)

Thanks again for the advise and wisdom. You guys are a blessing!

I bet your glad those attorneys sent you those letters..........

It would have been bad if you got pulled over with an outstanding warrant

Another one to be careful for is deferred adjudication. I submitted a ticket and paid for deferred adjudication. 18 months later a new insurance company ran my record and saw the ticket. I went down there in person and they wouldn't retrieve the ticket as it had already been warehoused and the judge wouldn't change it. They couldn't answer my simple question "why would I not defer it?". So my insurance rates have been higher for an error on their part.

The best is after this lesson I called back on another deferred ticket in another city to confirm it was filed correctly and they got mad at me for asking!

    Will do.

Yea.....its one of those things. You wanna trust people to do what they say they're gonna do....but....when they mess up....you're screwed. If you don't trust them and check up on them....they get hacked off. Its a rock and a hard-place. Oh well.....all apart of growing up, I guess. :)
