Opinions on case in Germany re: CS top speed?

    Interested to hear opinions on this case in Germany...

    'My Ferrari's too slow'

    A businessman who bought a brand new Ferrari is demanding his money back because it only goes 175mph.

    Berlin businessman Joerg Winterberg, 60, is unhappy his £111,000 Ferrari Challenge Stradale didn't reach the advertised 186mph.

    He said: "I could have bought a Porsche for far less and still had the same performance. I want my money back.

    "The prospectus promised the car could reach 186 mph, but in reality it can only go up to 175 mph."

    Ferrari have denied there is anything wrong with the car and have refused to give the businessman his money back.

    He is now taking the company to court after an independent expert also found the sports car could not go at the speeds promised.

    German motorists can travel at whatever speed they like on the country's famous autobahns.

    Seems like if the car doesn't perform as promised he should be able to get his money back. It's not really any different then buying anything else that doesn't measure up. Just my opinion.

    There were other posts on this but not sure what the consensus was as I lost interest.

    I wasn't sure if it had been posted yet or not.

    The case seems very similar to what Mazda went through with the Miata and RX-8 when their horsepower numbers were off.

    Someone mentioned this in the other thread. I think they had to retract the claim.

    in the states, you'd need to take the car to the same test track that the factory used to establish its top speeds, replicate as closely as possible the air conditions, and then have at it with THAT EXAMPLE to get teh company on the hook.

    Hopefully he's actually taken the time to break it in and whatnot... but who knows... some russian chick is suing nasa for 311MM...

    Funny at the Ferrari Challenge race in Fontucky the announcer stated the cars would hit a top speed of 175 on the straights.

    man, this post brings back some memories... i grew up in europe and over the years i did a lot of driving around germany ... the lack of speed limit on most freeways makes for some interesting driving.
    you are cruising along at 120-130 and all of a sudden some 'rocket' will go past you ... sometimes white and green police cars - porsches, of course, on a chase!
    no wonder that -with a couple of notable exceptions- the germans build the best cars, they can still ENJOY driving!

    Did this dude have a calibrated radar gun measuring his top speed???

    Sounds like a tough argument considering the various conditional factors.

    Maybe he should have it dyno-ed.

    The RX-8 was "recalled" in the same manner the '99 Mustang Cobra was. With the Mustang, the fitted a high flow exhaust and revised the intake to get some more power.

    Now, they rate the current Cobra at "390hp" which is underrated.

    I think the Challenge cars have more downforce from the wing and diffusers that lower top speed more than a CS... no?

    The Fontana Raceway is limited in length so by the time a Challenge car gets up to that speed, he's gotta scrub it off quickly so that's probably not a good indication of true top speed.

    Tube Guy or other CS owners, have you run yours up to that speed on that track or was the announcer just pulling that number out of his ass?

    Just curious to know if the CS can hit that speed on that track.
