    Many years ago I licenced him the right to make P 4/5 Go Karts. Not to use any Ferrari badging. So far I've received nothing.

    Did he not have to pay anything for the licence? - If he was supposed to pay and has not then legal action should be taken to either get the money owed or remove the licence and force the production of these go-karts to stop.

    If the licence was for a share of any money from go-karts sold then it could be that they simply haven't sold any so there's no money to be had.
    By the same token, if any have been sold then again, legal action is required to recoup any monies owed.

    As for the Ferrari badging, you cannot licence him to use those anyway (yes, I know you're already aware of that! :) ), and if he's not paid Ferrari to be able to use their trademark then I suspect he's about to receive a nasty letter from Ferrari's legal department!

    Based on our previous communications about protecting your IP rights when it comes to the P4/5, I'm slightly surprised that you have not taken legal action already (subject to the terms of the licence of course!)

    Just a guy who tried to make something that didn't sell. We told him long ago not to use Ferrari Badging. So far he's sold none so far as I know.

    I suspect he priced himself out of the market and wasn't prepared/able to lower his price to encourage sales.
    In many situations, when someone believes they have a product worth big money, they seem unable to accept the fact that it's not selling due to the price!

    As the old adage goes: "An item is only worth what someone is prepared to pay for it!"


    I would say though that it's very arrogant to use Ferrari's Trademark without authorisation, and even more arrogant to ignore the good advice given on the subject from a Gentleman such as yourself.

    Frankly, it's business suicide if Ferrari decide to take legal action on the matter, and the guy could end up losing everything he owns! - That seems like a silly risk to take to Me!
