    He says he DID pull the parking brake. And he has a video showing it. After he leaves the car the wheel locks themselves and that can be seen on the security footage of the shop. He thinks it is a manufacturing error. Also it was a 458 Italia.
    @fast_ian It was a 458 Italia and yes he thinks it is a system fail.

    I will post the pics I can find them.

    Ah yes the 458 wheels locks recall hasn't been done, now I understand.

    Me thinks I could hit my head with a ball peen hammer and it would hurt less than reading this tread.

    Interesting.

    I know it's easy to poke fun - I've certainly done it here....

    However, I can't help thinking I'd be majorly pissed if my car (of any make) took off down the hill after I set the parking brake.

    Lawsuit pissed off is maybe a different debate unless someone was hurt, but it's maybe a valid argument?

    As for turning the wheels into the kerb, come on - Not doing that makes it his fault?

    Fast_ian – Well yes to some degree – As you should know, in CA it is the state law to turn wheels to the curb when parking on a hillside. So I would assume that noncompliance of the law would be a defense for against OP’s “friend” in his legal action against Ferrari.

    That is the reason for the turn wheels to curb law to prevent exactly this kind of situation. OP doesn’t mention what state the accident occurred so can’t tell if it would affect the particular situation.

    Should have been an insurance claim and nothing more. Unless of course the car wasn't insured, and then I can see trying to go after someone for damages.

    Why would anyone video themselves pulling a parking brake ? That seems very odd...

    FWIW newer Ferrari parking brakes are odd things. Mine seems to have a mind of its own when it comes to engaging it. However, its never just turned itself off once engaged.
