Profiled By Police For Yellow?

    So I was driving out to my girl's house today. About an hour's drive. Along the way a deputy sheriff's car meets me on a 2 lane road (not much traffic) going the other way, I scope my rearview and the sheriff is braking braking and swerving to getting his car onto the shoulder / outside of his lane (a sure sign his focus is on his rearview mirror.) I drive into the small town where my chick lives, A local city police car is parked along the side of the road and follows me as I pass his sitting spot. Gets right up on my tail and as I turn into her neighborhood cop follows and hits his lights.... Now I was at no point driving above the speed limit so I knew I hadn't done anything wrong. So cop comes alongside my car and I ask him why I was pulled over. He said he needed my tag and license information becuase the deputy I saw earlier had radioed out that he needed it for an investigation into an "incident" my car was suspected to have been involved with. Myself and my car have not been involved in any incidents so I was kinda shocked by this. I hand over my license and thats that, he said the sheriff's office would be in contact with me. Now I live in rural Alabama area so a bright yellow car is indeed rare, all I can figure is they may have profiled me because of the color?? What do you guys think?

    Oh, reading the thread title I thought they profiled you because you were Asian. ;D

    It was obviously someone else they thought might be you.

    Well, it could be one of two things; either you were profiled, OR there was a yellow car that was involved in an incident.... Either way, so what. There's nothing you can do about it...

    Yellow could have a little to do with it, but it's also with what you drive. I get profiled by the piggy's in my truck all the time. I don't know why, but I've noticed it more within the last year more than anything. On multiple occasions I'll see cops/sheriffs either turn around or all the sudden be in my rear view. They'll be behind me for as long as it takes to see my record clean and the bust a big U and go find someone else who is more worth their time. It's really irritating to be profiled.

    Just stopping you without probable cause or at least reasonable suspicion & asking for your papers is Unconstitutional as it is unreasonable against the 4th Ammendment right to be free of unreasonable govt seizures

    cop in court:

    "he was speeding"

    "he crossed the center line"

    "something was thrown out of the car".

    they'll have no problem making up probable cause for a routine traffic stop.

    it doesn't work like that in traffic court. remember there, driving is a "priviledge" not a "right" and whatever the cop says is the truth - even if it often isn't.

    For a regular traffic stop (no search), all you need is "reasonable suspicion". This is the easiest standard in the world. Here are a few that courts have upheld:
    "He was driving too fast."
    "He was swerving."
    "He was driving too close to the center line."
    "He was driving too slow."
    "He was driving exactly the speed limit. (when others were going a little over)" ---I kid you not on the last one...I wish I still had the cite.

    Basically, the cops can get away with a basic stop anytime they want. Now if they ask to search your vehicle, that's a whole different story. However, most dumb criminals give consent to a search, even when they know they've got 10 kilos of weed in the trunk!

    With the proliferation of video cameras in cruisers the cops have to be on alert alot more-if he is following you and pulled you over claiming that you threw something out or were driving erratically, then let the tape show it. Video cameras, like DNA evidence, cuts both ways....

    If pulled over, always be respectful and curteous, but never, ever consent to a search of your car.

    About a year ago 2 people were pulled over in a car for speeding. The cop asked to search the vehicle, they consented, and cops found 2 bodies in the trunk. Now what kind of moron does that.

    It could be a new lamarossa, in which any cop would pull over in order to get that thing on camera.

    IIRC in CA recently they changed the law and police no longer need consent to search and seize your vehicle. welcome to one very crazy state! tip of the old iceberg folks, tip of the iceberg...

    If a crime or a car is stolen, there will be a broadcast out to all cars stating BOL for a _________---type of car ___________---type of crime etc.

    BS, as long as the Constitution is respected CA does need at least reasonable suspicion to stop you, and they cant just sieze your vehicle because the Cop likes it, like they do in other countries.

    4th Ammendment reserves the right of the people to be free from unreasonable govt intrusions into your property

    There is a big exception for autos in that Cops can search you entire car including the glove box & trunk w/o a warrant but they MUST have at probable cause to open your trunk

    Searching the vehicle is 1 thing, Siezing private property is something else. If you are illegally parked they can tow your car bcus there is a govt interest in clear traffic flow & safety but the Cop cant just sieze your car because he feels like it
