TBH, I think that's a pretty lame defense (aside from integrity issues). If the cop shows up and contradicts your statement about visibility, you'll lose. If the cop doesn't show up, you'll win anyway.

isnt lying in a court of law illegal ? therefore violating our new terms of service ?

Don't feel bad. On a regular street, I got a ticket for an illegal right turn, from the park police.


He got upset when I told him I don't think it was an illegal right turn and is a real cop going to show up?

You can take probation and have it dismissed from your record anyway.

Anyway Fan, I think you should just take the ticket and be at the mercy of the judge. By your own admission you were not paying attention and you have caused an accident. Why don't you just pay it and consider it an inexpensive lesson that could save your life one day?

 

Nothing, I asked 3 other real police persons and they said that it wasn't illegal and that they did the same turn themselves almost everyday on the way back to the substation.

So my big day in court arrives and the judge said "do you plead guilty or not guilty" and I said "I don't think what I did was illegal and I have asked a couple of cops so can't we just get this dismissed", to which he replied "Sorry but you have to plead guilty or not guilty and if you plead not guilty then I have to pick a court date, you have to come back and it usually take 3-4 hours for the court, if you plead guilty I can give you probation for 90 days and it would be 120 bucks". So do I waste a day or do I just pay the $120. I paid the $120.

In MD if you plead guilty the Judge will typically give you PBJ just like you got. But if you plead not guilty they will just hold you over until they run through the docket and clear the court of all the people wanting to plead guilty. The Judges here want to get out of the court room too and move it along.

 

I will RARELY ever talk to a cop if I know I am getting a ticket, BUT while in LA last month, I decided to drive forward down the street from my stopped position in a left turn lane. The first thing I said to the cop was "I DID see you back there and was wondering if you were going to pull me over"! He let me go. And no, I never saw him! Something about telling an officer that you knew they were watching you seems to change things in the drivers favor (Was not the first time I have done this to get out of tickets). Now, if you just committed a drive-by shooting and said that to the cop, there would probably be a different outcome

 

Not always true, I have been there, they just reschedule.

 

California courts are too busy to do that

 

Just print out this thread, show it to the judge, and everything will be OK.

Oh, and if you can't concentrate on driving while yapping on your phone - HANG THE F UP AND DRIVE!

Be an adult. You stated in a public forum that you are guilty. Lying in court is wrong. Plus the officer in his notes probably has you talking on the phone. Talking on the phone in a dense fog? Judge will throw the book at you.
