Reckless Driving ticket in Virginia?

    I could use a little help if there are any NY traffic attorneys. My sisters 17 year old got a ticket in Virginia driving 97 mph. I don't know what the speed limit was but I don't think it matters since anything over 80 mph anywhere in VA is reckless driving and that is the ticket he was issued.

    I have heard NY generally does not record traffic tickets recieved out of the state but since this is a reckless driving offense what will most likely happen? He lives in NY and has a NY drivers license. VA considers reckless driving a criminal offense.

    Anyone will detailed knowlege know how this will affect him? I think he has had his license for only a few months and is still under the probation period the kids have when they first get thier license? We know he has to appear in court and will need an attny.

    The car has already been taken away and why he was in VA in the first place is another whole story!

    Further west, Rockbridge County I think, Lexington Va, he wasn't on 95, he was heading to Oakridge TN for some tail. I believe a hooker in NY would have cost him much less and he would have had the afternoon free to watch the NFL games. I'm very dissapointed, I feel like I didn't do a good job teaching him as an uncle.

    I'm not sure why I should have posted this in the MidAt? I want to know how NY will deal with this after he deals with Virginia since his license is in NY.

    Perhaps I misunderstood your question. If it's just about reciprocity, I suppose NY would be correct.

    Reciprocity yes. I know NY generally does not care about moving violations out of state but I read they do if it's criminal negligence. In VA reckless driving is a criminal offense as well as a moving violation. I also read that if one state suspends your license that all other 50 states will as well. Just trying to find out what will happen to him in NY once he's done with VA.

    I'm guessing since he's a kid in school with no record, a lawyer will be able to get it reduced to speeding and pay a huge fine. In that case NY should not asses any points on his licence but he is still on the probation period for kids with a new license so I'm not sure how that works with out of state tickets?

    I was hoping someone with detailed knowlege of NY traffic matters would chim in.

    Call his insurance company anonymously & relay the story.
    They'll be able to tell you what they expect to happen from insurance surcharges (if any)

    If convicted, VA can suspend driving privileges in that state only. They cannot suspend an out of state license.

    The NY DMV does not record out of state offenses unless they are DWI/drug related.

    Short answer is nothing should happen with the NY DMV, and nothing should happen with your insurance carrier as they will not be notified.

    It would be a very good idea to get in touch with a VA traffic attorney.
