Rob Peacock, what an idiot.

    Bounces a check for $70K. Lies and uses every excuse there is. Finally after months of this, I've had enough and hire a detective/collections guy.

    Rob hadn't been amswering or returning my calls for a long time. This guy makes a living investigating auto fraud. Rob called him back in 24 hrs. Told a bunch more lies but made good on the check in 48 hrs.

    Now he won't reimburse me the 10% it took to get him to pay me.



    I love underdogs and when Rob suffered his setbacks last winter, remember when the snow load was too great for his tent, I was willing to let him put cars in my garage. I usually love to see honest, hard working people succeed.

    I'm still the same guy, but a little smarter about Rob. Elite Motorsports is getting a bad rap from what I've heard others say recently.

    Reputations are reputations. This one is starting to be understood by more people. I consider that a good thing.

    Rob owns Elite Motorsports. It is on Shady Grove Road next to JJ Muldoons in the location that used to be Eastern. He has an 11 year lease there.

    Among the lies is one he told the investigator when he said he had made the deposit, then gave an incorrect account number. He promised to produce a reciept that eavening or next morning. We confirmed that the correct number had been given to him. He was ubable to produce the reciept. Then the money showed up in the right place the next day.

    Some people like playing with others money. I was busy and trusted him so months went by that I didn't stop in, see him or talk to him. Sometime around New Years I stopped by and the car wasn't there. Nobody seemed to know where it was until one fellow volunteered that he thought that it might have been sold. Later I was told it was sold to one of Bill Marriott's sons, I don't know which one, who hadn't owned an XKE and had bought a series III as well as my series I.

    It wasn't until January 17th that I recieved a check, and then only by catching Rob at the office. The check was drawn on his service account (autocorp) not his sales account. That sent up a red flag but I was trusting. My detective tells me I am lucky that I got any money at all. He may have been planning on defrauding me the whole time. Of course he could just be justifying his fee. Whatever the auto fraud investigator said it worked. Robb had been begging my forgiveness, blaming his partner, it was an honest mistake, an accounting error, I'll pay you tomorrow, etc. until he just wasn't taking or sending calls.

    The check was deposited the day after I recieved it, the 18th, and returned to me on the 24th. That was a major Uh Oh and created preasure that I didn't need. All the lies added to the frustration and disgust, eventually leading to the expenses for the collections. Count them. That's six weeks. I think he probably could have done better if he had any interest in doing better.

    This business of cutting the check on his service side and everything before and after has taught me a lesson. I hadn't given the title over earlier and when I did I wasn't really happy with the check. I didn't think he would do what he did but I learned to demand certified funds or a wire. It's the only way I'll give a title again.

    I'm thinking of paying the homeless to picket his business on nice weekends this year. My next door neighbor has his Bentley there also. I wonder if he knows what goes on there?

    Seems he could just be VERY disorganized. I would hope that with an 11 year lease he would be wanting to build a positive reputation, and that he is just a goof ball and not a con artist.

    I am sorry for your thing with Rob Peacock, but I can only say good things about him.
    I bought a classic Ferrari last year through him and told him if he could sell the car for a decent profit I would consider to sell it again. So after a few weeks he came back to me that he had a buyer and he gave me a bigger profit then I had asked for, and the money was within hours on my account.
    So I can say only that I am happy with him.

    I was happy too until this happened. I can't explain it unless he wasn't being truthful.

    Seems like the logical explaination anyway.

    I mean it wasn't just once and there were six weeks in which he could have made any effort and chose otherwise.

    I dont know Rob, and I'm from Colorado, but I wanted to say that we had a dealer here that started being not-so-ethical and it was a sign of financial problems. There was a thread about it in the Rocky Mountain section. From memory, I believe up to 20 people didnt get paid for thier cars even though they sold via the dealer.

    Hope thats not the problem here, and I hate to see businesses get into trouble, but it does happen.

    Good luck with the situation, looks like it sorta resolved, for now anyway.

    I remember that thread and it had me plenty concerned. I know that there was a real possibility of not getting anything because I saw it happen to so many people out there.

    So when it came down to it I had to hire the auto fraud /collections guy.

    Like I said, there was plenty of opportunity for Rob to communicate and pay. Not a move on his part though other than to not answer calls. That's scary and rude.


    The moral here is to be extremely careful of third party sales.

    Unfortunate story.........

    Stan, how long have you known Rob? Was he a friend that has fallen on bad times or do you think this is inherent in his character? With the economy turning I'm surprised by some of the stories I've been hearing.

    Glad you were made (mostly) whole as it seems others might not be that lucky.

    Wasn't there a Peacock car dealership years ago? Is that still around? Same guy / family?

    I probably met Rob in 2004 when I moved to Potomac. He was running Cherner's at the time which was a mile down the road. So it wasn't hard to find.

    We went to Manhiem to wholesale my wife's S Class and drove back together in the Quatroporte that he didn't find a buyer for. He lost that location when the bank broke the lease in two weeks which made me sad for him. That led to the debacle when he was stuffed into the lot across from Benhke's in Potomac. Thats when he had a tent that took too much snow. I was really feeling sorry for him with that luck.

    When he started in the new location I was thinking of bankrolling him in a way. I was thinking of filling his inventory quickly for a cut. He had yo yo'ed his inventory. Dumping cars when he didn't have storage in winter. Then with the break on a new location which was a good bit bigger he wanted more cars for spring. At the time he dumped cars I think most of his cash was in the Quatroporte so he was trying to sell it real well.

    Glad I didn't do it of course. I just read too much risk and loss of control. It didn't give me the warm fuzzies.

    I like this thread title better than "what an idiot!".
    I would say "Rob Peacock, desperate used car salesman!!!!!".

    An "idiot" is someone so mentally retarded that you don't blame them for their actions.
    In this case, you have a small business owner with an obvious major cash flow problem.
    I guess a 30-day delay in the $70k payment is probably in the realm of still being honorable, so anything past a 30-day delay is starting to become abusive.
    Your original post said it was "months" so I'm assuming it was way past the 30 - 45 day window after the car was sold.

    Not returning you phone calls is inexcusable. In fact, I bet, if he personally called you with a sad story, you probably would have extended the payment beyond 6 months time "to help him out".
    The sad thing is, I think you deserve the $7k in collection fees on top of the $70k payment. However, I suspect, this is highly dependent on the language in your consignment agreement. I'm no lawyer, so this isn't legal advice, but if it is silent on late penalties, then it will be hard, IMHO, to collect that last $7k.

    So, what to learn from this unfortunate experience?
    If you are selling a car on consignment, do NOT release the title of the car you are selling until you get the equivalent of cash in exchange.
    If you are buying a car from a used car dealer, do NOT release the funds for the car until you have the signed-over title in hand (and all other contingencies, such as: tool bag, extra keys, owners manual, etc.).

    The ancient Romans invented the phrase "caveat emptor". Their thinking was practical 2000 years ago and is still sound thinking today.

    BTW, Stan, I loved your Series I E-type that was the subject of this sale. Great car! I have a 1970 BRG/tan Series II FHC that I'm the proud owner/keeper of.

    Good luck to you. If you don't happen to come out even in this transaction, let's hope something unexepected happens to your benefit.

    Thanks Toggie. Good things are happening for me a lot and I'm on to bigger and better things.

    But I still like to have fun also. I wonder if I can get those picketers to gress up in Rat costumes like Ratatouille. With the proper planning I bet I can get the press and TV coverage.

    Sounds like he has enough troubles already.

    Actually, my problem is since he got tossed out of Cherners, I have nowhere close to take my car to be washed. They really did a good job and Rob was an interesting guy to speak with.
