Anyone else think this is a bit heavy handed? Imagine you're driving down the highway - top down stereo up enough to hear over the wind... police car pulls in behind you - you check speed, nope, not speeding... relax, you're doing nothing wrong.. lights come on and Officer Rewak pulls you over.
"Stereo was a bit loud when you came past me back there.. according to our records you have been cited for loud stereo once before.... you haven't learned.. please step back while I get my sledgehammer and teach you what we think of your 'music' here in Lorain"

I mean come on! I don't like the obnoxious people cranking it up either - I just roll my eyes in amusement when I'm stopped at a red light and my mirrors vibrate from the subwoofer output of the car that just pulled up behind or beside me - but fine them for noise violations - destruction of property is wrong... for a private individual OR a cop... you think he's going to carefully remove the system and speakers from your car or care tht he's damaged a $10,000+ dash getting it out?

am I the only one who thinks this is going a bit far?

IMHO it appears police officers can do virtually anything. Yes there are many wonderful, honorable officers, yet there are also others that appear to do whatever they wish regardless of the law and without any worry of recourse.

Hopefully someone will get a very good lawyer and sue the officer/city/state over this action. IMHO the law allowing someone to act as judge and jury on the side of the roadway is illegal. Have a feeling this destruction happened AFTER the owner lost in court and subsequently handed over the goods.

    Steven,
I agree, but unfortunately I'll bet this will stay on the books a long time - because you can bet this will be selectively enforced.. if your vanity tag on the car says "LAWYER" or you look like you could afford to fight on principle I'd bet you get a warning... but the average person with a 20 year old ferrari with a now destroyed dash calls a lawyer and finds it's going to take $10k-$20k to retain a lawyer in a fight against city hall.... not likely to happen
maybe this idiot will take his sledgehammer to an enzo dash.. and the law will be changed... but I doubt it

I am a police officer and I think this is bullsh%&. These people need to fight this law tooth and nail. We have noise limits in MD.on the highway, but it's just a fifty dollar fine and I don't know any police officer that has written it for a first offense or second offense, usually just ask someone to down it down a little and there;s no problems. Only then after we have received complaints.

    Ohio actually ....

"Police have been regularly enforcing the law, approved a year ago, that prohibits car stereos from being audible 50 feet or more from the car.
A first offense brings a $300 fine. A second offense costs $400 and the offender's stereo gets confiscated as contraband. Then that stereo gets bashed to pieces, so it won't batter anyone's eardrums again.

Yesterday's front page showed a photo of Municipal Court officer Pete Rewak taking a sledgehammer to one of those confiscated car stereo sets, worth about $600. Last week, he obliterated another stereo valued at about $2,000.

Since last December, police have dished out 181 citations for noisy car stereos, and about 20 stereos have been seized and destroyed. The city has collected $8,000 in fines and another $28,000 in fines is outstanding, official s said.

Law Director Mark Provenza said that about 40 people a month have been cited for loud stereos during the past few months.

The stiff fines and cost of crunched-up stereo equipment puts a real sting into enforcement of the law, and, we hope, is a deterrent to potential offenders."

I find those sirens and flashing lights very annoying. Perhaps I should take a bat to them, smash them to bits? Sure I'll give them a warning or two first.

I think I'm in denial about how bad the police state has got in some places. Just because its 'legal' doesn't make it right....

And then Neocons wonder why people object to expanded police powers in the Patriot Act.

There are many, many officers that do their best to uphold the law. There are also some that abuse their authority.

What if it's a factory system? Our Mazda MPV has a stock 9 speaker stereo that can rattle the windows.

Do the police really have the jurisdiction to just confiscate the stereo without it going to court first?
