Last night the incredible did happen, in my own neighborhood. Driving southbound on A1A in Sunny Isles (Collins Ave.) I got pulled over by not one but 2 infamous SIPD Explorers. After going through the routine document check, I was given 2 tickets. 1) Passing withing 100 feet of an intersection. 2) Window tints too dark (installed by a dealer) Truth is, examples like these are becoming common grounds at small town PDs in Florida. The gargantuan display of manpower and machinery utilized day and night exclusively for this kind of scenarios, goes far beyond rational comprehension. Whether or not the infractions are arguable, I find it very hard to believe they are out there to promote safety. These people have no shame.
I agree...In my beach house on A1A in vero beach, one can't go a mile literally without seeing a law enforcement official...I would love to see this kind of "manpower" in the tougher neighborhoods in town...imagine a law official in Overtown ticketing someone for the same offenses you got flagged for....
So were your windows tinted too dark? Did they give you a "fix it" ticket allowing to correct the problem and in turn waiving the violation? I can understand you think its bull but if its the law and you broke it you really can't complain. Scott
Scott: Replying to your questions. 1) The windows are NOT too dark. It is average. I've seen many private (and police) cars, limos and buses with real dark tints. My vehicle doesn't even come close to these. And if the work was done by a dealer, my assumption is they should know what is legal and what's not. I don't see any standards or criteria on window tints in the FDL handbook. 2) The officer gave me a non moving violation ticket rather than a "fix it". Breaking the law is not what the majority of us pursue. But for instance, if the law says you cannot pass within 100 feet of an intersection, well, in this case we are ALL breaking it on a daily basis, including the entities enforcing it.
Florida does have a tint law which you can read about here: http://www.tintcenter.com/laws/FL/ Don't assume just because the dealer tinted it that it was done legally. Maybe you can have a tint shop measure the tint and see if you are within the legal limit. If so, by all means fight the ticket. I'm sorry to hear the officer didn't issue a fix it ticket. My personal opinion is that those are much better for public relations in these types of situations but I guess he can do whatever he wants. As for passing within 100 feet of an intersection, I didn't know what was against the law either. I guess we all learn something each day. Unfortunately, there isn't anything you can do about that. Unfortunately, there have been some rulings made recently that have affected the issuance of certain citations. I used to be able to cite illegal window tint under F.S.S. 316.610 which is the (Fix it Ticket Statute) The courts have ruled that we cant use the Fix it ticket statute for illegal sunscreen and have to cite under F.S.S. 316.2953 which is a non-moving violation. In Broward that difference is Improper / unsafe equipment (316.610) $95.00 W/Compliance $115.00 No Compliance. Moving Violation $165.00 The limit is 28% visible light transmittance. Under that and its a violation. Most officers, including me, give some leeway and don't cite until it gets below 15%. Usually the vehicles that I target get readings of below 5%. Oh and BTW ... Law enforcement vehicles are exempt from the requirement... as well as persons who possess a affidavit from their doctor citing medical need. ie: extreme sensitivity to the sun. BSO has a 35% limit on our vehicles for officers who desire to tint their vehicle at their own expense. As far as the passing violation. If you notice at most intersections the white dividing lines go from broken to solid at varied lengths before the intersection. You cannot change lanes at these lines or in an intersection. A lane change to the right can be particularly hazardous at a intersection due to vehicles turning right on red and that violation gets my attention quickly. It is one of the major causes of accidents at intersections.
You need to call Mark Gold at the Ticket Clinic. Better to fight than pay. It's not that expensive and probably will help keep your insurance rates down if you win.
They can give almost everyone on Collins a ticket from Sobe to Sunny Isles with that BS. Just revenue generating crap. That is why I drive everywhere with my Valentine One.
Elsewhere as well. I pulled off the Palisades Parkway into Fort Lee and made a left turn, like the vehicle shown. The local PD had set up a portable "No Left Turn" sign, which I did not see, nor expect. Also exempt from the cell phone talking law. I guess Just another example of Law enforcement saving us from ourselves. I wonder how they (personally) cannot recognize the idiocracy and bias of their work. Not a single policeman or court representative has a traffic violation on the record. It will soon be time to develope another policing organization to "watch" the watchers. Hopefully that will happen before it become us against them. Every time I see a police car coming from behind (they LOVE to do infamous "RICER" fly-by on me) I lower my windows, and put in 6th gear, so there's no NOISE nor windows tinting violation .... gotta watch now, ALL the time .... Oscar
oh they won't ticket for the same because overtown residents won't pay for it. tickets get written to collect $ and thats all they are used for, A1A is horrible between PV and St. Aug. every mile one of them is tucked in the weeds.
Would love to know what happen's to those intersection ticket cam violations when it's a off duty cop/family in a personal car...

Law enforcement representatives should set the example, not be exempted from the rules. I have no doubt there are many good cops out there.
