speeding ticket help!!

    yes, another one of these. but before i'm directed to check the archives, i'm doing this to see if anyone has some other suggestions. i have already run through a few threads for the speeding ticket thing already. my plan is to take it to court but i have a problem. i'm leaving on a 3 month trip next week. i'm going to be in hawaii for 3 months and won't be able to show up for a court date if it's any time during then.

    here's what happened. i was in maryland on 495S doing about 80ish in a 55 zone. well the cop was infront me a bit of a ways ahead and had quickly switched over to the center lane. i did too and slowed down. he then switched over to the far right lane and waited until i pulled up next to him. he then flagged me over and gave me a ticket. he said it was a VASCAR system he used, and because i had asked to see his verification for it, i couldn't fight him in court. i find that last statement he made hard to believe. but he said it was 4 points on my license, and he knocked the violation down to just a $75 for "speed greater than reasonable." my record has been clean as a whistle up to this point. does anyone one have suggestions as to the actions i could take?

    I do not understand the point system as we do not use it in my state. Was the 4 points for the original charge or what he reduced it to?

    Do you have an attorney that is a family friend, or know someone who is friends with an attorney? If you do I would either ask them to talk to the prosecuting attorney to try and work out a reduced charge or at least get it continued to a later date when you will be in town.

    I had a speeding ticket continued three times, by then it was out of the normal rotation of the cop so he wasn't there.

    might want to have an attourney fight this for you. it might be double the amount of the ticket - but 4 points! holy crap! that's a lot. and it doesn't seem like he knocked down the violation at all.

    he gave me 4 points to my license. i'm unfamiliar with the system too since they don't use it where i'm from either, but i've heard that's a lot.

    my mom works at the FTC so she told me that she's going to ask a few friends to see what they can come up with to delay my trial as long as possible.

    I had an identical situation. Had to close on a property the same day I had to appear in court. I called and re-scheduled with the secretary. She said “No problem”,

    I called her after closing my property to ask her what the re-scheduled date was and she shuffled some papers and replied “Mr Pimp, I’m so sorry I’m looking at an arrest warrant in your name.” HOLY S**T!!

    Long story short…She remembered me and I was actually able to speak with the judge over the phone . I had an immaculate record for the past ten+ years and the judge said OK send it to me in 6 months, if it’s clean I will dismiss the ticket.

    So I’m sure you can re-schedule your court date and with luck get away with the same thing.

    Also offer to pay the fine and ask the judge (kindly) to consider your past record and dismiss the points.

    Yeah, If you get it continued go check and make sure it actually got continued. My ticket got continued 3 times, 2 of those times they forgot to file it properly. My lawyer told me that they always call about a week later to confirm the new court date, when they did they were told that I failed to appear and that my liscense would be suspended.

    From what I've seen/read, VASCAR is a time/distance sort of thing. Meaning, that they have to know the exact time it takes a vehicle to go a predetermined distance. Seeing as how he was driving, the only thing he could technically get you on is pacing. That alone could probably help you win. Even if he dropped it down, if theres still points then fight it either way.

    I think you misunderstood. He does not have to show you any verification of the VASCAR or the Radar at the time of the stop. You can question him about his training and the system in court. It sounds like another officer may have clocked you and he just did the stop. If so then both officers would have to testify if you decide to go to trial.

    I think you are also wrong about the four points. The 80 in a 55 may be but the actual charge is probably less than this. If you will post the statute number from the ticket I can tell you the points. Is there a court date on your ticket? If not call the clerk of court and explain that you will be out of the state. Be sure to get her name and send a follow up letter stating that you desire to plead not guilty and asking for a trial date upon your return.

    You do not need to buy a book since almost all of the same information is available for free. This is a minor speeding violation and probably will have little effect on your insurance. Therefore spending money for an attorney is not economical. Show up on your court date and try to negotiate for a non-moving violation that will not go on your record.

    ferrari_kid: Take that advice :) And the whole Vascar thing about you not being able to fight it in court is untrue. First off like I said vascar, from what I remember, he would have to be sitting still or be able to see your exact distance not an estimation. Either way keep us posted on what happens.

    thanks for all the advice so far guys. apparently the maryland court system is so backed up right now they won't be able to give me a court date for another 30 days. not only that, the last time i called the clerk's office to see the status of my ticket, they said the officer has yet to turn it in. at this rate, i will probably be back in maryland to fight the ticket.

    the violation he gave me a was a 21-801(a) "speed greater than resonable." i know the officer doesn't have to show you their radar detector reading or any other certification information, but i asked for it after he told me that he used VASCAR to get me. that was when he showed me his certification and told me that i couldn't fight him in court after seeing that.

    i figured this was deserving of an update. but after 6 months of waiting i finally got to court only to find out the cop didn't show up. actually i got a FTA (failure to appear) at one point because i was held up at the security check point and the judge had called my name. apparently it was my saving grace because the court date i recieved after the FTA was struck from my record was the only date that particular cop didn't show up for. so i recieved not guilty after all of that research and planning. but now i'm curious if that TIPMRA defence would have worked, or anything else for that matter.

    Ask him for the statute that supports this retarded claim or ask your lawyer to provide it to you. Sounds dumb.

    You need to ask for a continuance & tell them when you will be returning from Hawaii & try to add a few months to that date :) Maybe by then the Cop will forget all about you & not show up in Court & you can get off free :)
