Today I received a speeding ticket for 13 over the limit. This is my second ticket, and I am only 17. If it is just a fine, I have no problem paying it, but I was under the impression that two speeding tickets while you are under 18 means an automatic six month suspension. I asked the officer who pulled me over and he said my license won't be suspended. I have a friend of my family who handles this type of law calling me back tomorrow after he reviews the ticket which I faxed to him. Does anybody know the specifics of the laws in Mass regarding this? If the law says it is a suspension, will I recieve one even though the officer said it would not be suspended (is the suspension at the discression of the officer, or will it come from the rmv or whoever automatically?) Any knowlege on the subject would be appreciated. Keep in mind I have junior operators license as I am under 18.

A speeding ticket is always a personal issue if ego gets in the way, but look at it this way, it is a tariff for having fun! Most the time we are not caught for adventures in the fun region, but a tarriff it is when we are! A good attitude is appropiate when venturing into the danger zone. I wish I could advise you on specifics for your area. Have fun but be safe and learn alot from your experiances.

I dont see where ego comes into this? I am more than willing to "pay to play." its getting thrown out of the game that gets me.

it is 2 if in first 6 months of license or 3 before 18. I believe it is 60 or 90 days not 180

Did you get an answer already? It doesn't look good from the research I did on it...

From the Mass Driver's Ed Manual:
    http://www.mass.gov/rmv/dmanual/chapter2.pdf

"Three responsible findings on speeding violations in a 12-month period will result in your license being suspended for 30 days. If you hold a Junior Operator’s License, two speeding violations that you were cited for before you turn 18 years old will result in your license being suspended for 180 days and 1 year for a third violation."

I think the key phrase there is "...violations that you were cited for...". It says this instead of saying something like violations you were 'convicted' of. It almost seems to suggest that as a Junior Operator you can't fight the infractions you were cited for.

Learn it now, always appeal. 13 mph is harmless with margin of error considered. If you have a flashy car, wear a ballcap, the cops have it in for you. If you fell into a radar trap, familiarize yourself now with the hotspots in your area. Limits are way too low, so a Valentine One can save you from more useless tickets. Boo hoo about encouraging speeding, critics can kiss my ass, cops and insurance COs are a scam and its been proven.

If your parents are smart, you are driving a lo HP car that can handle well (non SUV) if you give a kid a Geo Metro, he will still find a way to drift it into a tree once he hits 60 mph + after 15 seconds. So a safe car, smart trained kid, and a detector is the way to save yourself courthouse hassles against the man and the scam.

Where I live, if you get a ticket and you're under 18, you can't just "mail in payment"....you and your parents must appear in traffic court. If you have any quesitons, I'm sure they can answer them there.

That's part of the game too. If you don't know the penalties, don't break the rules. - Unsympatheticly.

BTW, Just how did you get your license w/o learning the penalties real well? Thought MA had a strong driver's Ed program.

The only smart thing that DadsFerrari said in his response is to always appeal at least you gave it a shot. By paying you have no chance at all. Being only 17 with a previous speeding ticket don't expect much. Usually if anyone has points on their record regardless of the age a court will not dismiss the ticket to a non-moving violation. Don't trust a radar dectector you will still get caught 9 out of 10 times.

If the state gives you 90 or 180 days it won't matter if your old man does the right thing. I would take the keys for a year and send you to a few driver classes. Looks like you are off on the wrong foot and not if you got caught in the same area/town all of the state guys know who you are. Take it and get the bike back out.

On the basis of living in MA and observing the general driving standards, I would substantially question the statement that "MA has a strong driver's Ed program"... :) mind you I didn't learn to drive here.

I was taught the basic principle of "mirror, signal, maneuver". If you drive on 128, the first 2 parts of that are regulary ommited.

    Unfortunately,
Driver's ED is like the old adage: "You can bring your horse to water...", actually exactly like the varient about the lady of ill repute...

You gus are harsh. I got my first ticket 3 weeks after I got my license. The cop was busting my balls. It's been a few years but it was something like 44 in a 35. Anyone who gives this kid crap for 13 over is a hypocrite or a saint. This is on a site where people regularly discuss places to break 100 MPH and not get caught.

PLEASE....not one of you got in the car yesterday and didn't manage 13 over the speed limit for at least a few minutes. He was just unlucky enough to get caught. (Of course the severity of 13 over is a function of the speed limit. Going 38 in a 25 zone in front of a school or playground is a lot worse than going 68 on the highway with a posted limit of 55.)

Lets face it, 95% of the time, the cops never bag people who are actually endangering anyone. They are just racking up some fines for the state to pay for the big dig.

I wholeheartedly agree with you birdman - I was just trying to break some balls with respect to driving in general in MA. I say if you haven't broken the speed limit somewhere by 100 mph over the limit then you haven't really lived :)

    How about an update?

I hate speeding tickets and I recently fought one and beat it in April! All I can suggest is fight the ticket and make sure you have a real case built against the cop. Don't just claim you were going with the flow of traffic or the radar gun was inaccurate. PM me the details if you want and I can try to help out (I learned a lot from fighting mine).

EDIT: nevermind, I see you are going to appeal. Good luck.

What kind of radar detector do you use?

I have K40s in all my vehicles and haven't had a ticket in 11 years.

ive just returned from a week vacation and a 2 week photography workshop, so here is an update. i would receive a 180 day suspension for the second ticket while under 18. i sent in my appeal request, and have not received notification of when my court date is, but my lawyer has gone through a few channels and found out so ill let you know how that goes in late oct.

as far as "doing the right thing" and accepting the punishment and taking drivers classes, i dont think any amount of knowlege will keep me from exceeding the speed limit. do you consider yourself a good driver? and do you speed? this was about the last site i would expect to be condemned for speeding on. for those of you who are interested ill give an update when i know more.

    Hi Spenser

Hope that you are able to successfully appeal the suspension.

As far as people giving you a hard time about it...don't let them get to you - they mean well and just want you to be a safe driver. Be careful with your speed, especially on residential and city roads with people about.

Laws are not always fair, and I hope that you are able to get your license back.

    Good luck!

    - Jon
