Speeding Ticket

    So sunday morning, coming back home on the I-15 (California), traffic is doing about 80-85 MPH. I am driving a red scion tc in the leftmost lane, going about 80. I see a cop in the horizon so I slow down to about 75 ish (going slower than traffic) the cop proceeds to follow me and finally pulls me over. I recieve a ticket for going 75 MPH. Do I have any sort of case against this? Is there any way I can contest this ticket?

    Speed limit was??? If it was 70, the cop won't appear. If it was 65, he will.

    Why don't you plead not guilty, get an extention and see if he shows up or not. If he does show, take the traffic school option.

    Just tell them that you were matching the speed of the traffic for saftey...but then you decided to slow down...to be unsafe?

    You're screwed.

    Pray that the cop doesn't show up. I was caught doing 61 in 30 and got 0 points after the speed was converted to be the highest parking fee on the curb ($150) from 8 points.

    Can he not frustrate the Revenue Collectors into a no-show? Reschedule the court date two hours before the time, schedule another and do the same again next time?

    "When you receive a traffic ticket, the court will usually suggest that you must appear twice to contest it: first to appear and plead not guilty and second to stand trial with the officer present. This is not true. You can contest your ticket by mail without making a single court appearance. Contesting your citation through the mail gives you a better chance of winning your case than at a court trial. Even if you seem to be guilty of violating the law, the procedural hassles for the prosecution will often lead to a dismissal. If the prosecution does not submit its version of events in writing to the court by the deadline date, your case will be dismissed regardless of your guilt or innocence. Dismissals due to lack of prosecution are won in approximately 30% of written defenses.

    The law allows you to contest any traffic infraction entirely by mail. You can appear via mail through a Written Not Guilty Plea pursuant to CVC 40519(b). In your plea you can request a Trial by Written Declaration pursuant to CVC 40902. In this way you can contest your citation without appearing at all and, for reasons already discussed, will have a better chance of winning than at trial. Further, if you lose your trial by declaration, you have 20 days to request a Trial de Novo (new trial) pursuant to CVC 40902(d). You then can appear in court for the first time for your second chance of winning."


    I've used the info in the website to fight a bogus ticket and won.

    Also check with sigalert.com and see if they can give you the average speed of the traffic on that stretch of highway at that time on that date. "Flow of Traffic" is something any judge will take into consideration

    Big mistake to stay in the left lane. Even if you are doing the speed limit. If you see a Revenue Collector....um, CHP, slow down and move over. Chances are he will pick off someone else up ahead who isn't paying attention. If he really had singled you out already it won't matter, but why tempt fate by staying in front of him?
