Speeding tickets!

Can anyone recommend an attorney on the west side of LA for traffic violations? Malibu has become a nasty speed trap...thanks.

 

I can recommend a traffic school. IF you got nailed by the sheriff, go and fight it. From my past experiences, they do not show up. LAPD, highway patrol show up.

 

Blame Malibu for wanting a safer community.............LOL!

Ok let's get real, your just angry because you were caught speeding!! What was the MPH over the POSTED LEGAL SPEED limit you were charged with? Any MPH over the Posted Limit is an infraction and ignorance of the law is not a defense in court when said rules/reg's are clearly posted.

Pay your fine and pay more attention while behind the wheel, driving is a priveledge so never forget that!!!!!!!!!!!!!

Driving is a right the state has turned into a privilege. You have right to get from point A to point B. Get an attorney.

 

If that is the case, why does Texas have a state law that traffic tickets over a certain metric are prima fascia evidence of a speed trap and must be turned over to the state?

I've had two my entire life - one for 67 in a 55 - and got a PJC for. The other, 107 in a 65, was "corrected" to "improper equipment".

So, technically, zero for me too.

 

Texas has some interesting laws. Their attempt to limit the financial incentives for smal towns to rip off drivers via traffic tickets led the State to enact a law in 2011 that limited the amount a county with fewer than 5,000 residents could collect in fines to a specified amount, after which they would have to send the money to the State. I was surprised to see how many counties in TX that actually had less than that number of people who lived there.

The law (and another one that year that dictates all traffic fines have to be used for traffic safety purposes) do not establish or comment on a "speed trap" per se, but obviously recognize their use by small communities as primary revenue sources. Other states manage the issue by prohibiting the 70mph to 25mph speed limit changes that are a hallmark of these areas (e.g., by requiring interim, stepped declines in the speed limit, along with warning signs of a speed limit change prior to the area, etc.).

Traffic citations can be a useful tool to help make the roadway safer (which is their original purpose) but can easily be misused for budgetary reasons as is the case here. In CA, for instance, the local community receives almost none of the revenue from any Vehicle Code citation, which helps to limit their issuance to folks who have actually done something worthy of a ticket.

My OP was a result of my observations and encounter with a motorcycle officer who is overly aggressive with his ticketing. I have seen him come out of hiding and race up to his victims so scarily that he rattles the hell out of them to the point that some people jam on their brakes and almost drive off the road. He has lately been hanging out near a construction zone where the speed limit has been temporarily reduced and is continually pulling multiple cars over in the transitional point. Abusive in my opinion. And yes, it has become a revenue producer for municipalities. So, thanks for your responses, even the guy who can't spell privilege. Lol.

 

You may want to show us where that "right" is couched. There are many ways to get from point A to point B.

Well, the law is the law, and speeding is against the law, so if you are speeding you are violating it. However, you are not necessarily doing anything unreasonable. You assume some risk every time you get behind the wheel, but in some cases exceeding the speed limit not only doesn't increase that risk significantly, it actually enhances safety.

In heavy traffic, I think you should go with the flow. If everyone were traveling at the same speed, there would be no relative motion, and collisions would be impossible. Of course, everyone is not going at the same speed, but if the average speed is 5 or 10 mph above the limit, as it often is where I live, I still think it is safer to keep up than to maintain the speed limit and make yourself a moving roadblock.

On the open highway with no traffic, if you are in a capable car and know what you are doing, you can exceed the speed limit substantially with acceptable safety. The speed limits in the US are very conservative. On a typical two-lane highway with a 65-mph speed limit, I would be quite comfortable doing 85 mph on the straights. Many drivers would be just as safe even faster. I rarely drive that fast because I don't like tickets (I haven't had one for decades), but I would not lose control of the car at such speeds.

Another situation where it is better to exceed the speed limit is in passing. On that typical highway, when you get behind a car doing a couple of mph below the limit, if you don't pass him you will soon collect a traffic jam behind you--a dangerous situation. If you don't exceed the speed limit to pass him, you will take a substantial fraction of a mile to get around him, which is obviously unsafe. In such situations, I downshift a gear or two, mash the throttle, and get back into my own lane ASAP. If I hit 100 mph in the process, so be it. Illegal, yes. But it's the safest way to pass.

 

The old Catch 22, I do not disagree at all.

 

that 2011 Texas law was likely a response to that small town where the sheriff, the judge and half the LE officers were citing people left and right, confiscating cars and cash, taking the money to send themselves to educational conferences in Hawaii and buying new cars/equipment with the cash. The judge was also found to take cash from the sheriff to rule on their side. What a racket!

 

Hold on a second- do you think that rights are somehow granted by the state?

 

Actually, I think some small town speed traps had the poor judgement to stop some state legislators.
