    I'm with Starbucks on this one.

    They have a trademark.

    You cannot be selective about how you enforce a trademark.

    Even if they sold NO glasses of the beer Starbucks has to tell them to stop. They did not "issue" a C+D- it's not a court order. It's a lawyer's letter intended to scare the infringing party.

    Trademark law seems almost ridiculous form the outside, but when other commercial operations are stealing your IP it becomes serious business.

    In this case since the bar is no longer selling the stuff the issue is dead. If the product was a sweater then this would be ridiculous, but since it is a drink it is not. One day when Coke introduces something with a similar name Starbucks will need proof that they enforced their trademark against ALL similar names.

    Under cases and controversies, I would argue that the drink was in no way similar to the Starbucks coffee and the spelling is different. Exit Six is in a totally different business.

    Or they can just be bullies, I have a letter from the law firm that represents one of the largest auto parts manufacturers in the world hanging on my office wall.

    They sent me one of them Cease and desist letters about me using their Trademark and a bunch of other BS.

    I called the lawyer up, he said he was going to sue me until I was out of business, He was very mean and curt. Said many hurtful things. The best part was he was way wrong in all of it. He had no case he had nothing. He was just a jerk...

    So I played his game, I said, Your going to sue me? He said yes. I said really cause I pray to god you do sue me, I wake up every morning wishing some jerk like you would sue me, as a matter of fact, I don't think you're man enough to sue me and then I hung up.

    Never heard from him, the law firm, or the manufacturer again.

    True story.
