suing for non-high-end performance?

    I just read this in the Dec R&T. It says some guy bought a 360CS and is suing Ferrari because when he drove it on the Autobahn he could only get to 176mph and that is 10mph slower than the advertised price. He had someone else independently test the car too and it didn't achieve the desired speed. Ferrari says there is nothing wrong with the car. Something doesn't sound right.

    10 mph difference isn't too much. You have to remember wind, road surfaces, etc can cause a change in top speed very easily.

    maybe because Ferrari drives their cars more aggressivly instead of the owner, which I doubt he does
